June 30, 2006 -- A Queens pistol-range owner busted last month as part of the city's anti-gun initiative sued Police Commissioner Ray Kelly yesterday, demanding the return of his clients' gun licenses, The Post has learned.
Michael Spallone, 43, co-owner of the Woodhaven Rifle & Pistol Range, was hit with a misdemeanor on May 24 for allegedly "delivering" a Glock-19 handgun to a civilian undercover investigator working for the city's corporation counsel.

The lawsuit claims the Queens District Attorney's Office has already indicated that it was considering dropping the criminal charges in the case - and says the "sting" was nothing but a mayoral publicity stunt, according to Spallone's lawyer, John Chambers.
 
Looks like that guy sold a gun under the table. If his clients' licenses were revoked because of his crime, they should be returned, but he should definitely be in trouble.

Wait, a misdemeanor? "Delivering"? I don't think we're getting the whole story here.
 
I thought that in NY you couldn't even touch a pistol without a license. I'll bet that's what happened. He probably let the guy hold it as a prospective buyer, or maybe let him rent it.

Sort of like here in MO you can't "acquire" by borrow, trade, sale, gift, etc any pistol without a $10 "permit to acquire" from the Sherriff. Of course, that makes it a Class A misdemeanor to let someone shoot your gun, or borrow it, or...
