Handgun shipped by FedEx ground

Hello,
Anyone know what might happen if a handgun was shipped by FedEx ground in violation of FedEx policy, then was lost or damaged?
I won a 586-2 on an online auction recently.
Finally received a tracking number, and the sellers FFL had shipped the gun to my FFL by FedEx ground. Afaik fedex will only ship handguns by priority overnight, and must be notified that a handgun is being shipped.
If the gun is lost, stolen, or damaged, did I just lose any chance at filing an insurance claim through FedEx?
Any liabilities on my part for this violation?

The seller should know better. If he has his FFL, then he should be fully aware of what can be shipped, by whom, and at what priority.

I would contact the seller and leave it in his lap to deal with. If they shipped it, they should be the one to rectify the situation.

But if the package is lost or damaged FedEx will be able to successfully resist any insurance claim because its policy was not complied with. That was the shipper's responsibility, but that won't help you.

So if the package is lost or damaged, your recourse would be against the shipper.
 
I may be mistaken but cannot a handgun be sent FFL to FFL with standard shipping ?
 
I think FedEx will ship 2-day, not just overnight. But that might still be considered air shipping. I know that SA had a deal worked out with FedEx when I sent back my XDS for 2 day shipping.
 
tracking number shows gun was shipped on the 5th of March
Expected arrival date on the 12th of March,
Shipped via: Ground.
 
Yes, if the package is lost or damaged, Fedex will deny the claim, and they will be right to do so. Most FFL's ship handguns 2nd day air or USPS Priority. At the very least, I would try to get the dealer to refund whatever you paid in shipping.

If the package was insured, you would have no need to explain what was in it, just that it never arrived...but the shipper would need to handle all that.
 
A pistol can be shipped FFL to FFL via FedEx 2nd day air, not ground. I get pistols in from my distributors in two days, either by Fed Ex or USPS Priority Mail, and generally from other FFL's via USPS Priority Mail almost exclusively.

They will also ship by 2 day.

You never had ANY right to file a claim no matter how it was shipped. Only the SHIPPER can file a claim.

You didn't ship it so you have no liability.
 
Did you pay the guy before he shipped? Seems like that may be the real problem--seller won't like having to eat the cost of the lost gun, so good luck getting your money back if that's the case.
 
Its on the seller if the gun is lost, but I wouldn't worry - its very, very unlikely to be lost. If the seller ships a lot of guns he may have simply decided that its cheaper to ship ground, save $40-50 per gun, and replace the occasional lost gun out of pocket.
 
I have played pattycake with FedUPS about all I am going to.
Any time I buy a gun now, I make it clear to the dealer that he must provide shipping at his business rate or provide the USPS paperwhipping for any repairs or customizing.

I'm familiar with cases where the seller insisted that as soon as he delivered the gun to the shipper, he (the seller) had fulfilled his end. From that point on it was between the buyer and shipper.
 
There is no prohibition on shipping for an FFL holder. I sold an FNP to a guy in Washington. My cousin shipped it via U.S. Post Office.
