Actually, I think it was a pretty much unbiased article. The last line was a simple quote put in a context that was easy to understand, and believe. I can see thinking the exact same thing that Mijares did if it were me in his situation.

That, as well as "what in the hell was this stupid m#### f##### thinking about when he pulled a toy gun on a stranger?"

As a side note: The title of the thread is a bit misleading. From it, I was under the impression that a good guy had turned a dirtbag into a good dirtbag, not simply got him busted. He'll be out again, and he'll still be a dirtbag - maybe with a real gun this time.

I'm with Janitor, didn't see any particular bias, just the victim lamenting over the stupidity of it all.

Seems to me it would have been a righteous shoot had he actually shot the perp - the dirtbag was close enough (Proximity), had a weapon (Ability), Intent (gimme $$ or I shoot ye),and the vic was in fear for his life (thought it was a 9mm). From society's POV, too bad he missed:uhoh:
 
Gotta wonder why the fool was carrying a BB gun? I mean - if you're gonna rob someone and point a gun at 'em to do it you might as well get the real thing. BB gun - Desert Eagle - armed robbery is armed robbery.

If he had $1000 to buy a Desert Eagle he wouldn't need to rob people for crack money.

Funny how the writer still tries to portray this guy as some nut who would kill over a BB gun.

Re-read the article. The line about killing a guy over a BB gun is a direct quote from the intended victim. Stirkes me much more as exasperation on his part.

As in "Why would somebody be so effing stupid as to attempt a robbery with a BB gun?"
 
BB guns are not toys. You can certainly lose an eye and even be killed with a well placed shot and a high powered air gun. Just the risk of losing an eye would be enough for me to want to respond with force.

Yeah, but how many BB pistols are that powerfull?

I'd have shot him even if I thought the caliber was lower than 9mm. .25acp, .22LR are still very dangerous from a pistol. Very capable of causing death or serious harm. Heck, they have .17 HMR handguns out now, don't they? Aren't standard BB's .17 cal?

Did my research: standard BB guns are .177 caliber, so they'd actually have a larger bore than a .17HMR.

If it looks like a gun and you're pointing it at me, I'm going to assume it's real and deadly.
 
in the middle of an adrenalin dump, do you really think you'll be able to tell the difference between the muzzle of a real gun pointed at you vs a bb gun?

Don't you see the obvious fact here? Bad Guy can't buy a gun because of our fine gun controll laws! The poor basterd has to use a BB gun....hmm.. maybe we need more laws controlling who can buy BB guns... Oh Lord! I'm starting to think like a politician...:eek:

Actually, it's more accurate to say that he could have killed a guy who robbed him at gunpoint. End of story. If you credibly believed it was a real firearm, it was a real firearm. That's how the law views it, and that's how morality views it.

Now, this raises an important question: If a robbery victim DOES recognize that it's a BB gun and not a firearm that is being used to rob him, is he justified in using DPF against the robber, for fear of grievous harm or death from the BB GUN?

I feel that DPF would be justified. What do you think, and what do you think that the law would think?

My vote would be to **** and simply stick to, "I thought it was a real gun!" whether you knew it was a BB gun or not.

I have one airpistol that has a design that places the actual muzzle in a recess. At the initial glance, the muzzle appears to be about 45cal. With the proper lighting and a careful look, you can see back into the recess to the actual muzzle which is .177" diameter.

I wouldn't want to get shot with an airpistol. They're not usually very powerful, but they can be lethal.
