i'm running out of space in my safe and would like to sell off some of my firearms...a few long guns and handguns. my questions is, how do i legally sell them to a private party that also resides in the state of illinois? does an ffl have to be involved? do i just need a copy of the buyer's foid and details of the transferred firearm (serial #, model, etc.)? or is it more involved?

thanks for any input.

You don't have to involve an FFL unless you want to have a firearm shipped to you.

Both you and the buyer must each see the other's FOID and record the number. A photocopy is easiest and safest. You are required to keep this on file for ten years.

Your buyer must wait 24 hours before taking possession of a long gun, 72 hours for a handgun.

From www.illinoislawhelp.org
Any private individual who wants to sell a gun must follow a variety of Federal and State laws. First, the buyer must be an Illinois resident. Second, buyers must have a FOID. Third, buyers can't have any of the characteristics listed above that a FOID is supposed to screen out, nor can they be: mentally defective, dishonorably discharged, or convicted of any kind of criminal domestic violence.

Fourth, for 10 years after the sale the seller must keep a written record of: the date of the gun's transfer, a description of the gun (make, model and ammunition size), the gun's serial number (or "other identifying information" if there's no serial number), and the buyer's FOID number (a photocopy of the whole card would probably be better).

Fifth, and finally, the seller must wait 24 hours before delivering a long gun to a buyer, and 72 hours for handguns. Private individuals don't have to do background checks like licensed dealers do, but they're still subject to the Illinois waiting periods.

I'm actually not sure what I want to part with yet. Contenders include:

1) Marlin 1894c .357/.38 lever action
2) Marlin 30/30 lever action
3) Beretta Jetfire
4) Kel-tec p32
5) Sig 239
6) Kimber gold match series 1
7) sig 220
8) s&w 640-1
9) s&w 442 (+p)
10) ruger sp-101 2"
11) s&w 332 (.32 h&r cent.)
12) s&w pre-36

still trying to decide which ones to let go.

Don was thorough in his response, but I don't think the seller needs to show his FOID.
