I bought a shotgun for my father-inlaw for Xmas and want to make sure that I have the legalities covered.

I am an Indiana resident and he is an Illinois resident with a valid FOID card. Am I correct that I have to keep a record of the transaction for 10 years along with a copy of his FOID card and all necessary information on the firearm? Serial number, make model, date of transfer, etc.

Anything that I am missing?

Any help from the legal scholars would be appreciated.

Thanks
SAINT

Well first of all, you're not allowed to transfer it to him yourself in a face-to-face transfer, since ya'll both live in different states. The shotgun must go through a FFL at least on his end, if not both (some states both sides to utilize a FFL).

So no, you don't have to keep any forms for any number of years - if you want to keep the reciept from the shipment to his FFL, you're perfectly legal and smart to do so, but there is no requirement.

I'd guess(almost bet) that Indiana doesn't care what Illinois law says. You only need to comply with Indiana's and Federal laws. Your father-in-law needs to deal with Illinois' silly laws and Federal laws.

And Federal Law states that the shotgun cannot be transferred privately between individuals of different state residences. It can be shipped to an FFL in Illinois for transfer, in which case the transfer would only have to meet Illinois state law, or the transfer can take place at an Indiana FFL, in which case, both Indiana and Illinois states' laws must be followed.

Handguns must be transferred by an FFL in the recipient's state of residence only.

Google "Title 44 Chapter 18" you want section 922.

Here's what you need to do..

1. Go to an FFL in Indiana who will ship to an FFL in Illinois.

2. Have your dad go to an FFL in Illinois who will receive the shotgun from your FFL.

3. Exchange the FFL information (name, address, phone, etc) with both FFL's.

4. Have your FFL ship the shotgun to your dad's FFL.

5. Keep a copy of all paperwork generated on your end.

6. Your dad will go to his FFL with his FOID, fill out the necessary paperwork, wait 24 hours, and then will be receive the shotgun. Your dad will have paperwork from his end which he should keep.

7. The only unknown is what dollars your and his FFL's will want to conclude this transaction.

FFL to FFL shipments are not law and can get quite expensive.

Just mail the shotgun to an FFL near your dad's house, and let him know where to go pick it up.

Nalioth has a valid point...but FFL's in Illinois typically won't want to receive a firearm from a non-FFL.

If the OP is close enough to drive, he can deliver the shotgun to his dad's FFL himself and then they can go do father-son stuff.
