**UPDATE** GBI: Store owners acted in self-defense

The local paper had an article today giving an update on this incident.

Northern Judicial Circuit District Attorney Bob Lavender could not be reached for comment Monday, but issued a statement that the case is closed.

"After discussing victim and witness accounts, crime scene documentation and forensic evidence submitted to and examined at the GBI Crime Lab, authorities have concluded that the manner of the deaths were the result of justifiable homicide," Lavender said. "Therefore, based on all evidence known by investigators to date, no action is warranted and the investigation will be closed."
I bet those people are just glad this is over. Of course, it wouldn't be too surprising if one of the dead teens families try to sue the Dosters in civil court but I doubt they would have any chance of winning.

Some [ahem] lawyer will take the case, and try to sue the Good Guys. Unless Georgia has some sort of pre-emption law... :cuss: :cuss:

What I would like to see in all states CCW/Castle Doctrine law..

Words to the effect of "When the District Attorney For the People of the State of ________ says that it was justifiable homicide/self-defense, etc. Case is Closed. No suit against the people involved; their assigns and heirs are held harmless."

Not exactly the way it would be worded, but the gist of it is there.

There was nothing wrong, from a legal standpoint, concerning what Mrs. Doster said in that news interview. Apparently, the D.A., who probably understands legal matters better than most gun rag writers, agrees. Remember, guys, this happened in GA, not MA, NJ, NY, MD, IL, KA, or some other sissy state. :)
 
I was down there (Oglethorpe Co.) for a turkey hunt last night and today and stopped into their store for breakfast.

They were real nice folks and made me one of the best sausage biscuits I've ever had.

I'm sure glad they made it through this thing alright and am mighty proud of them.
 
I hope those two are okay. Surviving a robbery, gunfight and killing two people is not a walk in the park. I pray they have a lot of support in the coming days.

It's best not to say such intemperate (but understandable) things to the media. It sounds sensational, but it could come back to bite them in the butt. I would be worried about retaliation from other criminal acquaintences.

Also, I hope some sheister lawyer hired by the perps' families won't go after the store owners with a lawsuit on the basis of the wife's comments. There is no insurance policy that will cover this!
 
Here's the way it is. There is no doubt that this was a deliberate, intentional shooting on the part of the storeowners. This means that the insurance company will find no negligence or liability on the part of the storeowners, so there will be no coverage. THis is a double-edged sword. Many P.I. lawyers will look for an insurance-coverage situation, hoping for a settlement from the insurance company. Ain't happening here.

Good news, less likely to get a greedy lawyer to file a suit.
Bad news, the store owners won't have the insurance company to pay for their defense if a suit is filed.
Good news, a jury trial will likey clear the store owners of any civil liability.
Bad news, the cost of fighting it all teh way through trial may be astronomical.
Worse news, you can never predict a jury's verdict. They could lose.

Say a prayer for these two, next time you're doing so.
