I was convicted of a felony for agg bat in 1998.I know this is said all the time but it was self defense.I just didn't want to leave my fait in the hands of others,so i copped a plea.Anyways...I applied for a foid card in May of2005 and received the scathing letter "you've been denied".I checked yes for having a felony.I have had a series of jobs and other things requiring a criminal background check and never been denied because of it.I think it might not be showing up.Is there any thing I can do to get my card.I have atleast six employees that go hunting and I can't go.I am a successful business owner and pillar in my community.
Please help.
Thanks in advance.

To be blunt, you're screwed. Felony conviction automaticly rules you out for legal firearms possession in the USA. Sorry.

I think your only hope is to receive a full pardon. I could be wrong about this, though. Others will likely have more information.

Edited to add: I think there's an acception made for black powder arms, and possibly other antiques. Something about the definition of "firearm" requiring the ability to accept modern fixed ammunition. Of course, state laws might vary on this.

Technically I dont think you can even have a firearm in your hand. :( Getting the felony expunged is probably the best bet.

Contact and attorney. There is nothing anyone here can do to help you other then suggesting you contact an attorney. I'm not even sure an attorney will be able to do anything for you, but you won't know for sure until you find a qualified attorney and ask him.

The letter should have mention the provison that you can get your gun rights restored 10 years after conviction. Wait two more years and then talk to a lawyer.

I had a felony conviction, but it got reduce to a misdemeaner after my probation was up. I got the denial too so I had to send a copy of my court record.

Good luck to you.

I am not going to pass judgement on you.

What I am going to say is that expungement is a very technical legal specialty, requiring the services of a specialist lawyer.

It may or may not be available in your case, depending on your crime, its disposition, and other aspects of your record.

That is pretty much your only lawful course of action, and you will not find anyone here helping you with unlawful courses of action.

You may or may not find yourself firearm eligible at the end of this process.

Good luck, thread's done.

I'm going to post one closing thought after my esteemed colleague.

Many times we caution young men here to avoid a conflict rather than take the "I'm right and I'll go down fighting to prove it" approach. This is why. If nothing good comes of this thread, let this new member's experience be an example for others. One conviction, right or wrong, can eliminate your right to keep and bear arms. The decision to engage in conflict rather than avoid it may have long lasting effects. The choice is yours. Choose wisely.
