Illegal hunting charges dismissed against 3 Pa. bear hunters
Associated Press
WILLIAMSPORT, Pa. - Charges of illegal bear hunting against three central Pennsylvania men were dropped when a judge ruled they were too far from a hunting club's bear feeding stations to assume they knew they were in a baited area.
Samuel Shaheen, 73, of Cammal; Donald K. Stroble, 70, of Mechanicsburg; and William Shaheen, 69, of Williamsport, each shot a bear on Nov. 21, 2005, the opening day of bear season, near Mountain Meadow Lodge, also known as the Frozen Run Hunting Club.
Accused of hunting too close to feeding stations on the club's property, they received citations that accused them of use of artificial bait and unlawful taking of bears and called for $1,360 in fines.
Thomas Marshall, attorney for the three, said the nearest of the bears was nearly one-quarter mile away from a feeding station and the farthest was nearly one-half mile distant.
County Judge Richard A. Gray ruled that reasonable hunters where the men were located "would not believe that they were hunting in a baited area." Gray also said there was a reasonable doubt whether the feeders were close enough to lure the bears the men had shot.
Contacted by the Williamsport Sun-Gazette, the hunters declined to comment
