This should be a good case to win. Imagine if you had to give up any other rights to foster children such as your 1st Amendment rights.

Kenneth and Colleen Shults want to permanently welcome a foster child into their Fairmount, Ill., family, but claim in a federal suit filed this week they are being forced to surrender their Second Amendment rights to do it.

Already parents of three, the couple is in the process of formally adopting a daughter through the state foster care system and is fighting Department of Children and Family Services rules they say severely restrict their gun rights. The couple charges that the firearm restrictions aimed at safeguarding foster children violate their constitutional rights and threaten their ability to keep their family safe.

A certain amount of due diligence is called for when placing a child up for adoption, but there needs to be some sort of limit.

The government doesn't keep you from having your own children if you own a gun.

At least, not yet.
 
This was an issue in NV too a few years back. A member here was dealing with it 1st hand. I don't know what the final outcome was.


It's not illegal for gun owners to procreate.

A lot of kids need good homes.... a lot of gun owners are good people.
 
Had a friend just get foster custody of his son-in-law's sister. They asked if he own firearms, he said yes. they asked if he kept them inaccessible to minors, he said yes. Good to go. Course, this is in WI, not IL.
 
Same thing came up when I adopted a child here in IL two years ago. During the pre-adoption investigation and home inspection the question came up if we own firearms. I had to show they were secured from small children.

"Except this one", I showed the lady as I lifted my shirt and presented the concealed Glock that I'd been wearing through the entire process. "This one stays on me."

Her eyes got big and she scribbled some notes, but nothing ever came of it. Adoption went through just fine.
 
We have foster kids and are looking to adopt as well. I've been asked these questions as well. Frankly it's none of their business. These social workers that come are mostly all obese and they are asking questions about guns that only account for a small fraction of deaths compared to obesity. Around 350,000 people a year die from obesity related problems. I printed out a page of facts about numerous ways kids and people die and handed it to her. I told her to read it and get back with me if she was seriously still wanting to know the answer to whether or not I have guns. Just a FYI, more people die falling out of bed each year than kids do from finding a gun in the house and shooting someone.
 
In the article I read about the case, the rule the government wants to enforce is that the firearm has to be kept locked up unloaded with the ammo in a different location. The family pointed out that that makes it impossible to use the firearm in self-defense. The wife has a job (I forget exactly what) where she works with convicted criminals and a warning was issued at her place of employment to exercise vigilance because some "clients" (or former "clients") have threatened the staff.
