Winnebago County in Illinois thinks they may have found a loophole allowing sheriffs to issue concealed handgun licenses. The County Board is currently exploring creating legislation to authorize the sheriff to issue ccw licenses under an interpretation of the auxiliary deputy statute that they claim gives them the authority to do so.

While the sheriff and the Winnebago County State’s Attorney’s Office claim that is a misinterpretation, proponents of the legislation also argue that the Second Amendment of the U.S. Constitution trumps state law.

While the issue is being decided locally, similar legislation is currently working its way through the Illinois State legislature that would overturn the statewide ban on carrying concealed firearms.
