Here is how this is gun related - one of the most convenient ways to present ID when purchasing a gun is to use your driver's license (DL).

Today the Virginia Dept of Motor Vehicles (DMV) announced that in order to comply with new regulations on confirming "lawful presence" they would be setting up a new set of rules on how you renew your DL. Starting in 2006 you will have to present "lawful presence" documents - birth certificate, Social security card, etc. - when applying to renew your DL.

AND they will take those documents from you and send them to a central processing center

AND they will scan them into a database

AND they will then do something to confirm that the documents you have given over to them are "genuine" and "legitimate."

So far a search of VA law and the DMV regulations shows nothing enabling this database, and nothing to restrict access to or use of information in the database.

On top of which, VA is in the process of contracting all of its IT to the private sector. There is a lot that is not going well with that plan, including a whole lot of "secrecy" that does not seem to be allowed by state purchasing and contracting regulations. There is also some action taking place that seems to suggest "they" are trying to fire a lot of the front-line state IT employees before this goes into effect, and that if they fire folks it will pave the way for IT activity to go off-shore.

I ["proud" voice] was not born in Virginia [/"proud" voice][flame suit on] and my birth certificate states in big bold letters that it is illegal to copy the document.

Now I am looking at a couple of possibilities -

1) I resist and go without a DL
2) VA DMV resists the "lawful presence" bs and my VA DL is no good for stuff like getting into a federal courthouse or the secure parts of an airport, plus probably all sorts of other stuff like not being recognized as legit by other states
3) I allow my BC to be illegally copied (I need to check to see if that is a felony or misdemeanor) AND scanned into some database whose security and asccess controls are not yet established.

THR-ers please tell me if my tinfoil hat is on too tight. If you think I need some duct tape to hold it on more strongly, please be sure to recommend what color to use.

Well, here we go with our wonderful "National ID" (Real ID). Most people will not care since it is "for their own safety" and all. You can try and make a statement but all that'll get you is no DL and driving without one is against the law. Who was it that said if the government cannot control you, they will just make everything illegal? Something like that.

Anyway, no, your tinfoil tension is just right.

Tension looks about right. I prefer at least two layers, with some foam padding underneath and between the layers. Just make sure that the shiny side is out.

Funny, I just got my renewal notice a couple of months ago. To paraphrase, "Since you been a good drone, errrr driver, (i.e. no tickets, no accidents), just call this toll free phone number with a creidt card number, we'll charge you five bucks and send you a sticker to put on your licence so that it's good for another 4 years." Five bucks and no standing in line at the Secretary of State's DL facility (Conviently located next to the Unemployment Office !!). Also, No request for [bad Nazi accent] "Paipers, Pleeze. [\bad Nazi accent].

If they did want to see them, I'd "show" them to them, but let them keep them ??? Nope. Copy them ??? I be tempted to have them sign something agreeing to be held liable for all costs associated and to be reimbursed for any identity theft incidents, to include punitive damages. (IANAL, nor did I stay a Holiday Inn Express last night.) Not sure if it would work, but it might be fun to at least try. I've found that if I can't win against a bureaucracy, I can at least do my damndest to gum up the works. :neener:

I prefer a nice OD green in Duct Tape, though I call it "hundred mile an hour tape" which I picked up in the Army.

Also make sure you wear it in your DL picture !!!! :D

Someday, in the history books this era will be known as the "Bend over and assume position" era.
 
The rules are already in effect, but don't apply to everyone...

"If your valid, unexpired license was issued prior to 01/01/04, you are "grandfathered" and do not need to prove legal presence at renewal."

I didn't have to prove legal presence this month to renew.

I wonder about those of us who just never bothered to change their DL from the last interstate move? Or the last several moves...

Is that gonna be a felony now?

Should I assume the position?

But .. but ... but..... This is all going to go into effect 1/1/06 and there is nothing about "grandfathering" in the new proposal.

I spent a lot of time on the phone to DMV and was just barely able to get it confirmed that the news info is accurate, and that after 2005 expires there will be no grandfathering.

I have been "told" that the info about my CHP existing is not in the DMV database but its existence is "tied" to the DMV info when the cops pull up my data. Since I can hack into that I guess I can hack into somebody's scanned birth certificate too, once it gets put in the database.

[sarcasm] Wonder how much I can make selling false IDs before I get caught? [/sarcasm]
