I was told I could only sell 5 guns per year FTF to someone. Does anyone know if this is true or not?

I'm not a FFL, but have bought and sold several guns latly. Most were registered in my name, and I did get a bill of sale from the person I sold them to.

There is no official definition of "doing business" selling guns. No number of guns, no idea of what amount of income counts. This lets the Feds prosecute whoever they want to and ignore whoever they want to.

Well, it's not much of an issue in a state that doesn't register your guns. It would also be more of an issue if you were selling nothing but the same model gun each time!

How many guns do you own? That is the number of guns you can sell in a year or month or week.

Well meaning friends are sometimes the wrong place to go to for advice, so is the internet. There is no registration in South Carolina.

I have bought sand sold more gunes recently than ever before. I left the Glock platform for a CZ platform.

I am pretty sure you are correct with 5/year. I remember reading a few yeard ago about it falling under RICO laws. I do not remember the exact statue or law verbatum, but one does exist.

no Fed laws or rules on number of weapons one can sell.there are some local restrictions on FFL's selling weapons . but if you and Bubba want to sell off your collected guns, have at it. but as already stated,if you selling a large # of guns, every week for several months,Mr. ATF will give you a call. there are estate auctions all the time that get rid of large numbers of weapons, but it's not on a regular basis. jwr

Creature,

One-gun-a-month rule has nothing to do with how many guns YOU can sell in a year or any other time period.

There is no statutory limit at the federal level. However, the BATF could make a determination that you were selling for profit and hence being an Unlicensed gun dealer. That determination could cause you some indigestion. However this happens very rarely. It is determined by motive and intent not number of transactions.

However, I know someone in Central Virginia that has bought up to a hundred gun per year from licensed dealers and probably sold every one with in a couple of months. He is very concerned with not violating the spirit, intent or letter of any law, he has not violated a state or federal law yet.

It's a subjective test, not an objective number. If you are buying with the intent of reselling, you are a dealer. It's 18 U.S.C. 922 (a) if you want to look it up. If I remember correctly one of the circuit courts set out a certain number as a safe harbor.
