Judge to Student: No NRA T-Shirt While Lawsuit Pending

CHARLOTTESVILLE, Va. (AP) - An Albemarle County middle school student will not be allowed to wear his National Rifle Association T-shirt to school while his lawsuit against the school system is pending, a federal judge has ruled.
U.S. District Judge Norman K. Moon's wrote in his decision handed down on Tuesday that Jack Jouett seventh-grader Alan Newsom would not suffer "irreparable harm" by not being allowed to wear the T-shirt.

School officials forced him to turn the shirt inside out in April after deciding that it violated the code against clothing that depicted violence. The shirt bears silhouettes of gunmen and the words "NRA Sports Shooting Camp." The middle school student has been allowed to wear other NRA shirts, Moon said.

The NRA filed suit against the school system in September, representing Alan and his father, Fred Newsom.

Moon said in Tuesday's ruling that the Newsoms are unlikely to win their suit, which names Albemarle School Board members, superintendent and school principal. It will be heard in July.

I bet the school district would let him wear a NARAL/Planned Parenthood shirt thou Or, how about Chairman Mao?

They will lose if the school dress code reserves the right for the school to deny any particular piece of clothing. If it says so in the student handbook, they basically could do anything they want, for any particular political/non political message.

He should wear a different pro-gun shirt every single day, with no evil gun pictures on it, just to piss them off.

Dress codes in schools are pretty much up to the administrators. If one or more of them thinks something is provocative and could lead to disruptive behavior, the decision to bar it will usually stick. Seems like barring students from simply wearing gang colors has been upheld.

IT'S A SHIRT.

If it were blank, it would be just a shirt. The school doesn't seem to object to the kid wearing shirts, just THAT shirt. Why? Because it isn't just a shirt, it is a statement. The 1st amendment counts just as much as the 2nd.
