Hey all,

I have a few questions about Kansas firearms law. I live in Overland Park, Kansas. According to my research, it seems that it is legal for me, as a 19 year old, to buy a pistol from a private seller. It is also legal for me to recieve a pistol from a family member as a gift. Do you think this is correct?

Also, my friend wants to know if a misdemeanor marijuana charge and a misdemeanor paraphernalia charge which ended up in county court and resulted in a conviction and probation when he was sixteen, would disqualify him from being able to legally own or buy a long gun in Kansas. He is now 20 years old.

Thanks for any and all advice. The fact that firearms laws are so intricate makes me want to :banghead:

I can only comment on your first question. Your statement is incorrect.

At 19 you may buy a pistol from a private seller who resides in the same state as you, in this case, Kansas.

At 19 you may receive a pistol as a gift from ANYONE who resides in the same state as you, in this case, Kansas. The gift does not have to be from a family member.

I would think the person in question #2 would be OK if it was a misdeamenor punishable by less than, I think, 1 year, but that one I am not sure on. He can try to buy the long gun from an FFL and as long as he answers all 4473 questions truthfully he will be OK even if he gets denied the purchase.
 
I went to file a VAF with the ATF due to being delayed every time I purchase a firearm. That is when I was informed that it is over two years for a misdemeanor and a year on a felony. Handguns have to be in state, or shipped to an FFL in state. Long guns can be purchased by KS residents in Nebraska and Oklahoma, although I think it still involves an FFL in the states of purchase.

Kansas residents are not limited to purchasing long guns in Nebraska and Oklahoma. They can purchase long guns from FFL's in about 42-45 other states, whose state law does not prohibit the purchase. The out of state purchase of a long gun must be made from an FFL - or if from a private party, shipped or delivered to an FFL for transfer.
