Can anyone point me to a specific statute or legal opinion showing that it is legal for someone in Kansas (my mom) to give a non-felon, legal gun owner 20-year-old (me) a gift of a handgun for Christmas? She asked me what I wanted, and I said a Hi-Point .45 ACP pistol and a box of .45 ACP ammo. I printed off the page from Bud's Gun Shop showing where they are selling it for $147. Her only caveat is that she is a lawyer and as such wants to make sure that everything she does is within the law.

So a link to a website or government agency confirming that this would be legal is all I need at this point (Info specifically stating it's legal in Kansas would be even better)! Help a fellow gun enthusiast out.

Your mom should NOT mention to the dealer that the gun is a gift, especially to a 20 year old. There is absolutely NOTHING illegal about it, but a lot of FFLs will be squeemish at the thought of her buying the handgun as a gift to give to a person who cannot legally purchase that handgun themselves from a dealer.

BTW, would your mom be interested in adopting a somewhat older brother for you? :)

What about NC ?

Not meaning to hijack the thread, but I have a similar question regarding my wish to gift a glock 23 to a nephew, a resident of NC, and I am a resident of OH. No shipping involved, just questioning what if any paperwork or FFL might be required. BTW, nephew has NC CCW.

Thanks-

Federal law requires that the firearm be transferred through a licensed dealer in North Carolina. Your nephew is not allowed under Federal law to acquire a handgun outside the state of North Carolina.

You can take the handgun to an FFL in NC or ship to an FFL in NC to complete the transfer.

Actually, the Federal prohibition is against acquiring the handgun from an out of state source. If the Uncle were to bring the handgun to North Carolina, then the nephew would be acquiring the handgun in North Carlina, but it would be illegal, without an FFL, because it is from an out of state source. :D

Just a minor technicality of words, but the difference between legal and illegal.
