Legality of Pepper Spray in Schools?(OH)

Could there be legal concerns of any kind associated with pepper spray on school premises?

Absolutely. Double check the fine print of the weapons policy for that particular school.
 
In today's litigation-happy society, when are there not "legal concerns"?

2923.11 Weapons control definitions.



As used in sections 2923.11 to 2923.24 of the Revised Code:

(A) "Deadly weapon" means any instrument, device, or thing capable of inflicting death, and designed or specially adapted for use as a weapon, or possessed, carried, or used as a weapon.
Pepper spray is not considered a "deadly weapon" in Ohio however it most certainly is included in most student handbooks as a weapon. Heck they specifically mention "Sharpened Sticks" in most of them and I guess that means no pencils?
 
Aside from school district rules, I suggest you research the actual LAWS in YOUR jurisdiction.

I've never been a stickler for observing mere rules, but running afoul of actual laws can have more negative consequences.
 
A student in Canton, OH was expelled for having pepper spray. Rules about chemicals.

Rules coold also impact employment.
 
Since chemical sprays are not covered by state preemption, one would also need to check local ordinances.
 
As you've no doubt noticed, where you are matters. However, I'd be very surprised if any school board or college BoD thought a kid or college type having pepper spray would be a good idea.

What kind of school? Are we talking about adult students or minor students, faculty, or adult visitors or parents?
