Ebay does not allow any firearms parts or accessories to be shipped internationally. A friend of mine wants to buy my harris bipod for the M1A.

Now, we all know that Ebay is the devil and is a front for the new world order. :fire:

Would it be violating any international gun trafficking laws to send my bipod (and probably my scope mount as well) to Cumnock, East Ayrshire, England?

I wasn't aware of Ebay being in the positition to declare what UPS, USPS, and others are allowed to deliver?

I'm not an expert, but I don't believe that a Harris bipod or a scope mount is considered a firearm by any Govt agency.

What eBay doesn't allow is offering for sale such items to individuals outside the USA.

so does that mean

that i'd be a criminal if i send him a bipod for the m1a? its sort of an m14... but that's a select fire... not the same thing really...eh.

That is one of E-bays crazy rules, not Federal. I tried to list a front sight POST for a AK, a few months back, and they told me I was violating federad laws selling assault weapons. I informed them that a sight post is too small to even throw at someone. They responded that THEY consider ANY part of A ASSAULT rifle a weapon.

Put the parts in a box, MARK THE BOX AS A GIFT ( no customs fees for your friend) list contents as machined tool parts, and send them.

Ebay is based in California

So that says a lot right there.

Unless it's classified as a firearm, it's not a firearm and normal shipping rules apply.

Ebay is just silly in this regard and have lost a lot of clients to Gunbroker.com, Auctionarms.com and others that are gun friendly. I bought a scope from Gunbroker and the seller called me to followup and make sure he kept his 100% feedback rating. He had some pretty colorful anecdotes he shared regarding ebay and guns and their moronic California-style gun rules. He swore to never use them again.

To answer your question , it is perfectly legal ,from the U.K. side , to send these items to Scotland ( where Cumnock is ) . They are not classed as firearm parts but as accessories . They are sold without problem by E-Bay here .

Don't you think the question could be better answered by the ATF and/or ICE? They're the ones who will be enforcing any bans, not some anonymous responder on a forum.

You think they give you the heebie jeebies now. Just take the wrong advice from some anonymous person on the internet and you'll think heebie jeebies will be the least of your problems.
You asked for legal advice. How do you know you've gotten the correct info? You pick and choose the wrong answer and no one here will be your defense. Bringing in a copy of an email answer from an anonymous person on a public forum won't even be admissible in court. Who ends up getting stuck in the end? You do. So if your freedom, money, and time is worth nothing more to you than taking unsubstantiated anonymous advice from people then you deserve the results you get. Just don't come back on here crying the blues when you end up getting charged with a felony, heavy fine, and possible jail time.

isp2605 , when someone asks a question they are asking for the practical everyday experiences of responders ,if they wanted a legal opinion they would ask a lawyer . I know the situation in the U.K. and presented it . I am so anonymous that the poster could easily contact me by loking at my profile .
Most posts are asking questions , surely that is the purpose of a forum such as this .:)

I'm happy you know the situation in the UK. However, that doesn't mean a thing on this side of the pond. There are US laws prohibiting importation of firearms and parts without proper export licenses. Doesn't matter what the UK allows. Just because the UK allows parts to come in doesn't mean he can ship them out of the US without an export license. Your profile won't help him at all if he violates US customs laws concerning the exportation of firearm parts. If he violates a US export law, your profile won't do him a bit of good. It won't be you paying his fine, paying for his attorney, or sitting in jail.
He doesn't need to ask a lawyer. He needs to contact ICE or ATF. Those are US governmental agencies which can give him the correct answer on what he needs to export parts. Whatever you do on your side of the pond is immaterial to what he needs to find out.

Actually the controlling agency is the State Department. You need to get an export permit for war material (or something like that, I forget the exact nomenclature)

I've dealt with both agencies extensively. Calling them up and asking questions of the first person who answers is not the correct procedures. Ask for the correct bureau/section and they'll get you the right answer.

Now that you mention it, you are correct. The State Dept is the agency granting export permits. It's an ATF form but it has to be run thru State for approval.
It does go by the name of implements of war, to include firearms and firearms parts.
