Looking for info on Ohio gun laws.

I'm trying to sort out Ohio's stance on guns. Things like does protecting your property allow use of deadly force? For example, shooting someone that is stealing your car may be legal in Texas but is it here? Not sure where to find that information. TIA

I'll summarize for you, though. Just remember, I'm not a lawyer, and I don't play one on TV.

1. CCW is verbotten. There is an affirmative defense written into the law, but that is used at trial (as in, you'll be arrested and tried). Also, CCW applies to "any deadly weapon or dangerous ordnance" concealed "on or about [your] person." Needless to say, in a just world that would be void for vagueness. There is legislation pushing its way with glacial slowness through the General Assembly that could change all of this, as well as an Ohio Supreme Court case that could make it all disappear. We'll see.

2. Deadly force is generally deemed OK when it is used to defend yourself or another from serious physical harm. In other words, axe-weilding madman coming right at you? Good to shoot. Guy stealing your DVD player and running away? Not good to shoot.

3. Ohio generally follows the duty to retreat philosophy. If you can get away without using deadly force, you should. All bets are off, however, inside your own home.

4. There is no state preemption of weapons laws, so each little -burg and -ville gets to make its own lists of not-ok weapons and items. AFAIK, only a few have, but be sure to check your local listings. Columbus has one, but court cases have rendered it pretty much null.

To add to Coronoch's post, City of Cleveland has some sort of registration thingy...Since I don't live in Cleveland/Cuyahoga County, can't say for sure what it is....think it applies to handguns, though.

And NO CCW for the unwashed masses. Almost had it earlier this year, but the decent bill the Ohio House passed got trashed by the Spineless Ohio Senate, with help from Guv. Boobie "Flip. Flop. Which way is the wind blowing NOW?" Daft, in cahoots with the Ohio Hiway Patrol and the F.O.P.

OHP Superintendant McClellan said he couldn't find any evidence that CCW made crime go down, or that people are safer with CCW. Capt. John Born of the OHP (Akron area post) publically stated more than once that people attacked in their cars can "Just drive away".

Then Guv Boobie wanted to add a provision in the CCW reform that people with others in their cars under age 18 had to do the separate locked storage thing....as an example, weapon locked in trunk, ammo in another locked compartment. How long would it take for the criminal element to figure out that "mom" with small kids in the mini-van doesn't have CCW weapon ready at hand? SHEEEEEESHHHH!. you can bet on the next election I'm looking for the TATBO button (Throw All The Bums Out)

Sorry, didn't mean to vent so long or hijack the thread. But when folks that are SUPPOSED to represent/serve/protect us, and be so smart, make statements like those above, well, it just galls my gizzard.:fire: :fire: :fire:
 
There’s a law in Dayton that says all firearms owners must purchase a Firearms Owner Identification Card (FOID).

I know a lot of gun owners in Dayton, and each keeps forgetting to purchase their FOID... ;)
