Louisiana: Permit Carry in Restaurants That Serve Alcohol

On the NRAILA page there are two bills. One for allowing suppressors while hunting in Louisiana. And this bill, which would Permit carry in restaurants that serve alcohol. I did two separate posts because these are two different issues but are linked to the same page.

"On Wednesday, the House Administration of Criminal Justice Committee approved NRA-backed House Bill 72 by a 9 to 4 vote. Sponsored by state Representative Joe Lopinto (R-Metairie), HB 72 would clarify that concealed handgun permit holders may possess firearms in restaurants that serve alcohol. "


The bill resolves a potential conflict as noted below.

"House Bill 72 seeks to resolve a potential conflict between two sections of state law: under R.S. 14:95.5, it is unlawful to possess a firearm in any commercial establishment where alcohol is served for consumption on the premises. The only exceptions to this are for owners or employees and law enforcement officers acting in the course of their official duties. Although the concealed carry law clearly states that bars, not restaurants, are off-limits to license holders, another subsection of that statute prohibits permit holders from carrying in any area where firearms are banned under state or federal law. That subsection, read in conjunction with R.S. 14:95.5, is where the potential conflict arises. Every other state allows civilians to carry firearms for personal protection in restaurants that serve alcohol. HB 72 will clarify that Louisiana permit holders have the same right to self-defense in these establishments."
