Manufacturers Change Look of AR-15; Rifle Is Now Legal in New York State

It's not as popular in CA due to the more common use of a "bullet button" style magazine lock with 10 round magazine.

It's interesting to note that the "bullet button" style magazine lock is not legal in States (NY, NJ, CT, MD, MA, HI) with worst gun laws than CA.

IIRC, the bullet button is no longer legal in CA.

Sadly it won't take long to ban. The SAFE Act states the Superintendent of State Police has final authority on whether a questionable item is an assault weapon or not.

And the Governor has been orally changing the law quite a bit since it was enacted. He may have read the news when this came out over his morning coffee and decided to just amend it.

Yep, as I understand it, the law prohibits ANY mags of over 7 rounds. Even if attached to the gun. So technically your typical pump action shotgun is illegal because theoretically you could load it with those 1.75" mini shells and be over the 7 round limit.
The SAFE act magazine capacity limit was amended to 10 rounds in December.

Incorrect.
Last year, the CA legislature passed a bill to make it illegal but CA Governor Jerry Brown (Democrat) veto'd the bill, saying it was an unnecessary infringement that would have no impact on public safety.

Definitely still is legal, but obviously only on rifles with off-list lowers.
Correct.
And it is confirmed via CA case law ( Haynie v. Pleasanton), a "bullet button" style maglock when properly configured/used is a legal compliance device.

Do AR pistols comply?

No stock at all. SIG has a nice brace for it, tho. Ten round mag. Short pistol barrel. It's a pistol, not an "assault" rifle.

Anyone remember when "switchblades" were made illegal in the early '60s? Well, the real offenders just moved up to handguns, the unintentional consequence. The knife industry took a pause, then Spyderco came out with the hole in the blade. Others were already retailing clamp on thumb studs, and America's most popular knife, the Buck, got a quick deploy sheath.

Today, we just don't wait around for innovation, we work at it. Give the American entrepreneur an obstacle, he sees a marketing opportunity.

How does the SAFE act view guns with two magazines? Frankly, inventors and gunsmiths are going to go out of their way to come up with new interpretations on the laws unspecified aspects and force legislators to keep confronting the hasty measure.

This isn't a disaster, it's an exercise in educating politicians, and if we rub their nose in it long enough, they will get tired of it. They can be made to look like fools, and even the citizens who don't care either way about guns will note it.

1) The 7 round, amended to 10, magazine restrictions apply to detachable magazines. A Tubular magazine is not impacted although, under the letter of the law, it may be illegal to load more than 10 rounds at a time.

2) There is no "ban" on semi auto rifles under the Gun Owner Discrimination Act 2013. Somebody was just smart enough to work out that banning a whole class of weapons would invite SCOTUS rebuff. The ban is on the largely fictitious "assault rifle" defined by features specifically identified in the law, detachable magazine, pistol grip or thumbhole stock, evil flash under etc. Since the law specifies the features that make an "assault rifle", those without such features are, by definition, not "assault rifles". Any delegation to the State Police after that is moot and subject to likely successful legal challenge. Amendment of the law is fraught with peril for its backers because it opens room for more amendment than they would like.

3) That freedom stock sure is fugly.

Under the NY SAFE Act...
AR pistols are considered assault weapons because they accept detachable magazines and accept those magazines outside of the pistol grip.

AR pistols can be made legal by welding a 10 round magazine in place and not having a threaded barrel.
