marlin 1894 44 magnum problems please help

Like the thread says I have a 44 magnum marlin .. I have 2 problems with this fire arm when i go to rack the lever sometimes more then 50% of the time the leaver hangs up and doesnt want to rack is there some thing that would cause this ? i have looked at the lever and it looks no diffrent then my 1895 marlin there are no burs or nicks what can be causing this ?
And also every time I fire this rifle the lever comes undone from the bottom like its jaring open is there a catch that is no good or something?
Please help ?

Marlins have 5 year warranties, take it to the service center......

I would if this was new but it is pre cross bolt safety and i got it on the cheap ..
