If i purchased a barreled action for a mosin that had never been assembled into a rifle and i put a mosin sock onto it that had been cut down to a pistol grip with no buttstock would it be considered an SBR or could it be just a pistol?

If it had never been assembled as anything, then it would transfer on the 4473 form as an "other firearm" and could be assembled as a legal Title I pistol or rifle.

If it had ever been installed in a stock designed to be fired from the shoulder, then it is a rifle or a "firearm made from a rifle", i.e.: "SBR."

And, just for curiosity sake, where are you able to get a Mosin action that has never been assembled as a rifle?

if there's no butt stock or forward vertical grip, its a pistol.....

Think about the ruger 10/22 charger or whatever the little pistols called...not to mention a Thompson Encore, Contender, or any of the various remington models over the years... Pistol.

i have not actually found one yet but i figured if i purchased a receiver and barrel and had a gunsmith assemble them it would be just a barreled action that was not a rifle, but im not sure so thats why im asking here

I imagine you'll have quite a hard time finding a Mosin receiver that hasn't been registered as a rifle by Mother Russia, but if you do, I hope you realize what a wrist-breaker it's gonna be.... :-0 You'd be a bigger man than I, to fire that sucker!

The firearm would have almost certainly been an assembled rifle at some point who's receiver had been harvested off the rifle (or the parts robbed off the receiver). It would be unfathomable that you would be able to find a Mosin Nagant receiver that hadn't been on a rifle in its nearly 80 year life.

so i would just have to assume it was once a rifle? where can i find the paperwork for an SBR :D

probably a good assumption, you can go the the BATFE website and request an order form for the SBR I believe.

If you're building it yourself, it is what's commonly called the "Form 1:"

As for it being a "wrist-breaker," MANY single-shot pistols have been chambered in larger cartridges than 7.62x54R. I held an XP-100 in .308 last week which would be pretty close in recoil. The weight of the gun, the type of stock, muzzle-breaks, etc. all can help mitigate felt recoil.

In the end, you're just making the classic "obreyz" which has been discussed here many times.

Thanks for the help everyone, ill be sure to post pictures and a "range report" if i end up doing this

They had some service history I believe. They were used as concealed weapons by partisans on the eastern front, and IIRC the Finns had a version that was used to fire some kind of illuminated round for signaling to aircraft. But I'm not sure where I read that last one.

A full power 54R is going to have some stout recoil, and the muzzle blast would be astonishing. But if you handload you could create something more reasonable.
