I was just going to say that I didn't see anything in there about reciprocity, but it's a good start. Now you guys just need to get your politicians to recognize the rest of us.

Also, I do see some potential trouble with Section 16 (mandatory report to the police any time the gun is fired). If that report is subsequently used as evidence to form or prosecute a case against the permitholder, wouldn't that be a Fifth Amendment violation? Just something that jumped out at me.

I understand what you are saying, but here in NE it simply is not as bad as Wisconsin (good reason to join us :) ). I'm not from Omaha, but I work here. I live here. I carry here. Concealed, and open carry depends on where I am. I'm from out west, and I carried weapons from the time I was about 5 years old.

My point is I have been stopped before, with a concealed weapon. And the serial no. came back stolen (Which it wasn't , I had a .45 and the stolen weapon was a .38, anyway...)
I told the officers I was carrying. I was honest. They called for backup. I was in handcuffs for two hours, but the end of the story was they let me go; they wrote my up for the non-moving violation for which they stopped me. Why did they let me go you ask? Because I am not the bad guy. Because they had no real case. Now how about them apples?


A. All state law is written in such a way right now that it's unlawful to carry concealed, but there are justifiable defense reasons, read above. Open carry is perfectly legal.
B. Omaha Municipal Code says you must register your concealable weapons, but this law was passed in the prohibition days, to deal with mafia we had in town. OMP also states you cannot carry a loaded concealable weapon without prior training. Training is about $100. However state law trumps Omaha Municipal Code. Our state constitution state the right of the citizen to keep and bear arms shall not be infringed. That means any odious law that does step on this right, however small is tossed. Honestly, I drive the speed limit, I mind my own manners, and I don't get stopped. Aside from some Iowa po-po stopping me for seatbelt violation I haven't been stopped in 7 years. And I'm not worried about being stopped. That pretty much means I carry however I want. And I get away with it.

Now let's say this silly law passes. Suddenly we have this whole "papers please" thing going on. The local law enforcement already doesn't know the law. I have had to show them or remind them in the past. But passing another law is just further bondage. It's not freedom. And freedom is not guaranteed, it's fought for. You know, if Omaha gun owners would just start an "open carry my gun" day. And simply went about their normal day to day activities people would wake up and realize the laws right now are fairly decent. Toss the concealed carry restriction that is currently on the books and we'd be perfect.

LINCOLN, Neb. -- Nebraska's governor signed LB 454 on Wednesday. The bill will allow Nebraskans with a permit to carry a concealed handgun, but residents of Omaha aren't included.

For much of the state, the law would take effect on Jan. 1, 2007. Residents would have to complete training, pass a background check and pay a $100 permit fee. Concealed weapons will still be prohibited in schools, athletic events, churches, hospitals, bars, banks and anywhere else business owners don't want them.

Before now there was NO RESTRICTION put upon many of these locations, federal regulations aside. And many police officers were very lax regarding this. I even knew a school super that still used used a .380 revolver for track meets up until a few years ago. And local citizens and police knew. They just didn't care. Now tell me this does justifiable defense still trump this new law, or does the CCW bill now supercede Section 28-1202 (2)?

The new law is silent on the issue of allowing cities who don't currently have them to pass their own bans. Even so, Conboy believes Omaha's existing restrictions on handguns will still be enforceable.

"We have (a) charter to regulate concealed weapons, the new state law won't affect our ordinance," Conboy said.

Conboy expects the ordinance to be tested in court once someone is ticketed or denied a permit. Until then, he continues to research the law.

Great now we have a cowboy in the prosecutor's office. He will fight this law tooth and nail. For all the guys promoting this law, thanks for rocking the boat....


Sen. Jeanne Combs sponsored the law, and said it was not her intention to create a patchwork of laws. Combs said she wanted the law to cover all of Nebraska. There was amendment proposed that would have required statewide implementation, but it failed.

Gov. Dave Heineman reiterated the constitutional right of Nebraskans to bear arms during a bill signing ceremony on Wednesday.

"Criminals already carry guns, and they already do it illegally. LB 454 helps law-abiding Nebraskans, like the citizens of 47 other states, make criminals think twice about choosing a victim," Heineman said.

Okay, I'll give them credit. They didn't anticipate this development. However I did anticipate this. Now the authorities in Omaha metro are going to push the issue. They plan to circumvent more than 35% of the Nebraska population from carrying, where they need it most.
And while I do believe their intentions were honest. But there is some saying about good intentions paving some road.

Great new law, big whoop. Okay fellow Nebraskans, just get used to hearing "papers please".

What shall I do? Don't know, I just know I'm really angry about this...
