need advice concerning SS disabilities and gun rights

heres the predicament , I was told by a friend that her therapist said to try to get a temporary SS disability to help her out on the grounds of her disease which causes the person to have emotional problems at times and caused them to have a hard time keeping employment , now this person is a resposnable gunowner and will not go near her firearms when there condition gets bad ( depression ) now this person has not ever been institutionalized by any means and is just seeing this counsler, by declaring the emotional problems would they be unable to own firearms by federal law . we looked into Ill state law and there is no ruling since this person has not been institutionalised for help .
 
Under current law I think she's ok (if I remember right the form only wants to know if you've been institutionalized against your will). Of course future changes could be a problem.
 
I don't think the govt should have a say in a case like this (depression), but I don't think it's wise for someone who experiences chronic depression to keep firearms around. As responsible as she may be, if her condition is crippling enough to interfere with working, it can surely get bad enough that living doesn't seem good.

I've known a few people with serious depression, and once they're in the middle of it, you can't count on their being rational.

A finding by the Social Security Administration that a person is disabled due to a mental disorder is NOT an adjudication of mental incompetence, and does not legally affect RKBA. If you need further info, drop me an e-mail at [email protected]

As a side note, there is no such thing as "temporary disability" through the SSA.
 
thanks tommy I will be in contact with you .. August , when she has boughts of depression she often quits her job or doesn't show up for work and gets fired , she also is a truck driver and that job is rather stressfull due to the hours and lack of real life( I have been doing this for 12 years and know from experience ) , when she gets really depressed she ussually calls me. I store her firearms in my safe at my house because she has nowhere to keep a safe at her apt and she is religous so theres a very low chance of suicide.and the safety apptitude she has is great , the one time she wasn't feeling good she didn't want to go shooting . she is in self control and can put herself out of harms way ..
 
The only problem I can see is if, IF, the person is determined by Soc. Sec. to be unable to manage their monthly check and a payee is appointed to receive the check for them. Probably wouldn't be a problem if this happened, but stuff happens...

Nope. Believe me, if anyone would know, I would. A close friend of mine had to deal with that exact issue. He recieves SSI from the government on a representative payee system through his mother. Needless to say, since he won't be living with his mother much longer, I had to research every piece of possible issue. When I get him from New York and bring him home to Oregon, I plan to get him on his feet. He has no valid photo ID (only an expired one) because his family doesn't want him to leave. Only they have the documentation that he needs, like a birth certificate, to get a state ID or learners permit. He's 23, btw.

Those bastards are not only thieves, but liars. They lied to him on so many issues that it's taken me a long time to untangle all the crap that they've lied to him about. For example, they said that carrying firearms of any kind in this country was illegal. In the county in NYS where he lives, he can get a Class F Pistol License (our equivalent to a full carry permit) no problem.

Unfortunately, there's no way that he can fight back right now. He's living in an extremely rural area of New York State, he's nowhere near Albany or NYC, and if he gets kicked out in attempting to get ID, he'll be stuck homeless in a NY winter far away from any shelters.

Either way, I'm going to have to fight with SSI and his mom to get him his benefits while I untangle the mess when he gets back here.

Needless to say, I intend to pay for his carry permit. :)

His birth certificate is on file in the county where he was born. A certified copy costs about $10, and can be ordered online from a service that does exactly that. He needs to know DOB, mother's and father's name, and a few other details.
 
Wrong on all counts. It cannot be ordered online from the city he was born in (Danbury, CT). They require valid photo ID, and it costs 5 bucks. He does not have valid photo ID.

I've heard some people say "Try to convince the parents". I'm sorry, but that's almost the same as "Try to convince the sheriff you need a carry permit". It's ludicrous.
 
well this person can take care of her finances as shes been doing it alone for a long time and she does have an Id (Cdl) so no biggie there , just a problem of trying to keep a job , and needs help paying medical bills for therapy and a roof over her head, I have let her stay at my house in the past but it kind of puts a kink in my personal life (esecially when it comes to dating .. ) and I know shes a gunnie but her and I have our diferences when it comes to certain things otherwise we would be dating. I will relay info .
