Need Help NH and MA gun owners...

Hi folks,

It looks like my family and I may move from NY to NH (woo hoo!) within a year. I have some questions for NH and MA owners....

1. Do I need a permit in NH to own (not carry concealed) a handgun? I currently own some handguns in NY (I have a valid NY state license) - if I move, can I bring my pistols with me without a resident NH permit? I don't plan on carrying the pistols without a valid NH license, but I would like to bring them with me to my new residence. In NY you need a permit before you can even own a handgun.

2. If I travel through MA on the way to NH, am I allowed to bring my firearms (unloaded and locked in containers) through MA without a MA license on my way to NH? If not, what do I need to do to get proper authorization? Or should I simply drive through Vermont to NH? It's a bit out of the way, but it might be an option.

I'm planning on checking with the appropriate authorities to get their recommendations but any help would be appreciated. Thanks!

in NH only a permit is required if you wish to carry concealed, I applied for mine online and went and picked it up 2 weeks later...

as far as going through mass, technically carrying w/o a license carries a mandatory 5 yrs, though it is rarely enforced (according to an uncle of mine, a former police chief in the boston area)

I dont see a problem if the gun is unloaded and carried in a case and locked in a trunk.

It's ONE year and an unloaded gun in the trunk is NOT "carrying."

Per FEDERAL law, so long as the firearms are unloaded, separate from the ammo and locked out of reach of the occupants of the vehicle (trunk is good; locked cases are better), you are protected while in transit.

This presumes you are legally in possession at the beginning and destination of your trip and you travel straight through (so forget the detour to see the World's Largest Ball of Twine or whatever).

Which means he will be a NEW HAMPSHIRE resident. So how does this make your suggestion viable? :confused:

Once he has established his NH residency, he can get a carry permit from NH and use that as the basis to apply for a NON-RESIDENT permit from MA.

One thing about Massachusetts is that you can visit someone and bring a firearm as long as it's locked, unloaded, and the person you're visiting has the proper permit type to cover your weapon. Once you get there, the law considers it under his/her control, and it's legal to unlock it once you're on their property.
 
regarding the "misinformation" tory, perhaps I wasn't clear enough.... thats the sentencing guidelines for carrying concealed a fully loaded firearm through MA.

This is the REAL "sentencing guideline" [sic] for unlawful possession of a firearm in Massachusetts:

"G.L.c. 269, § 10. Carrying dangerous weapons; possession of

Section 10. (a) Whoever, except as provided or exempted by statute, knowingly has in his possession; or knowingly has under his control in a vehicle; a firearm, loaded or unloaded, as defined in section one hundred and twenty-one of chapter one hundred and forty without either:

(1) being present in or on his residence or place of business; or

(2) having in effect a license to carry firearms issued under section one hundred and thirty-one of chapter one hundred and forty;

.....shall be punished by imprisonment in the state prison for not less than two and one-half years nor more than five years, or for not less than one year nor more than two and one-half years in a jail or house of correction."

Once AGAIN, the minimum sentence is "NOT LESS THAN ONE YEAR;" not the " mandatory 5 yrs" you claimed. Which is exactly what I had said in my first correction of that misinformation. :scrutiny:
 
The NH permit (for concealed carry) is cake for residents and non-residents alike. NH is a "shall-issue" state. If you do move, DO join Gun Owners of New Hampshire (GO-NH). They are a hardcore group. There is no purchase or possession permit in NH (unlike NY). If I recall correctly, open carry without a permit is allowed, but that could get you unwanted attention from local law enforcement in the Southern part of the state (say, Manchester and thereabouts), since a few of the local chiefs are anti-gunners from Mass.

After you get your NH carry permit, it would be advisable for you to apply for a Non-Resident Massachusetts Temporary License To Carry - Class A "For All Lawful Purposes." Generally, the state will issue you one if you fulfill all the requirements, namely, demonstrating that you have specific fear of injury to yourself.

This license (Mass) and subsequent renewals are a pain in the arse, because it has to be renewed annually unless you are a security guard. The fee is $100, but there are a lot of other hidden fees you need to pay such as getting a criminal history report from your home state and obtaining passport photos (another $30 or so +/-). Not to mention all the time you have to put into filling the application out and getting printed for the first time.

By the way, even though I don't live in Mass (or NH) anymore, I do send the poor souls at Gun Owners Action League (GOAL) a check now and then to keep up the (uphill) fight with the Commie Lib Occupational Government ("CLOG"). Might not be a bad idea to do same.

I've carried in the open while hiking in NH, but everyone I've run into is too busy returning my smile and greeting to notice or care about my sidearm.
