Hmm... Suit? I get mine off a rack with others. I'm sure a number of people could have tried it on before I purchased it. Must be used. Shoes? I buy them from a box sitting on the retail floor with many other boxes of shoes. I'm sure a number of people could have tried them on before I purchased them. Must be used. Hats? I buy them at a store off a rack with many other hats. I'm sure a number of people could have tried them on before I purchased them. Must be used. Underwear? Well, who honestly wears underwear?:D

The truth is that many every day items see some use before purchase. Typically this use is minimal. It doesn't mean that anything with any use at all must be labeled as used.

Unless the gun's firing is part of the manufacturing process it is used. Once it comes to the dealer, if it gets shot, it is used.

Used/new rules on cars differ from state to state. As far as I know, there aren't any legal rules re handguns. However, lets simply consider the ethics - if I am a dealer and really want to try out a gun, can I go shoot it, clean it up nice, and put it back in the case as new? I sure can. I shouldn't.
 
So if Wilson Combat builds you a $2500 custom 1911 and then takes it out to their range and puts a hundred rounds through it to ensure it's sighted in and functioning perfectly, now it is a used gun and not worth $2500? Because they were just "playing" with it? I think the main problem we have here is wildly differing definitions of the word "NEW". And the difference between "testing" and "playing with" a gun. If the entire finish is perfect and the action works perfectly I think any customer who wants me to cut a "discount" because he considers the gun "used" is being "childish" because it's not "new" any more. And if I was selling them a car the same deal applies.
REALLY?? Are you really equating a custom 1911 builder insuring proper function with a dealer who just wanted to shoot a gun that was in his shop. I think not! wow
