NFA CLEO won't sign, Writ of Mandamus

I'm currently looking for ways to legally purchase and own a suppressor but the sheriff's office here in Houston says they absolutely will not under any circumstances sign off on NFA items.

I've looked at the incorporation route, but it seems to be an awful lot of trouble with the incorporation fees, taxes, and upkeep fees. Plus you don't really own the item.

I spoke with someone and they mentioned I could file for a Writ of Mandamus with the local court to direct the sheriff's office to sign off on the Form 4. Basically it is just a written mandate from the court for a govt official to do their job. I.E. sign the form 4 because in Texas NFA is legal to own. Does anyone have any experience with going this route? Are there any legal types here that know exactly what the process for filing one of these petitions is?

Trying to find ways to legally own NFA items is SOOOOO frustrating. I feel... infringed! :cuss:
 
Sounds like Tejas needs a good sweeping at the next election. Maybe your CLEO should have gone to Oklahoma as well?

Ask around, boof. People who have difficulty getting sign offs on 4s in jurisdictions like Tejas are hesitate to tell you how they got theirs done (usually). How about trying your state association? Are they active?
 
Incorporating isn't really all that hard. Give Access Incorporation Services a look. You can incorporate in Delaware without ever setting foot there. This company does all of the paperwork and for $99/yr. they will file all of the necessary papers to keep it going. You can be the only officer of the corp and not have to pay any taxes on assets (ie NFA items).
 
I would contact the Texas State Rifle Association because I imagine they would want to know about this. They can also probably give you advice about the rest. Normally for filing a writ you need a lawyer but this could be an exception.
