I was talking to my local FFL dealer last week and the subject of NICS checks came up. Am I correct that all NICS checks are to be deleted within X#of days?
If so why does the dealer have to file the number of the check with the other paper work
If the check is deleted what good is that number or is it only to prove the dealer did a check?

Good question, Carl. I think your last supposition is likely correct. I can see no other reason for it. It is necessary for when, during a check, if the FFL holder is asked to hold for further review, that number is used to make sure the next person you are talking with at the FBI NICS is talking about the same person being checked. Other than that, I see no other reason for that number.

That said, it could be an accounting thing as well. Those call-in centers are subcontracted.

NICS are sub contractors?

Are you sure the people working the NICS check center are not ATF?
I was told that the NICS center is here in WV and run by ATF, where I now live.
I know there is a lot of misinformation out there.
 
I'm not at all convinced that they actually get deleted....

I know they are supposed to, but there's lots of things the Gov't is & isn't supposed to do that happen every day.

I suppose its possible these 'contracted" call-in centers keep a record. They are not the government. I think a FOIA request is in order.

Approved transactions are deleted at the close of the NICS business day (midnight Central)

The dealer writes the NICS Transaction Number (NTN) on the 4473 with the date of the the NICS check. He doesn't know at that point whether it will be a proceed, delay or deny........the customer service rep tells him that info after giving the NTN.

Only approved transactions are deleted. If the transaction was a delay, it would not be deleted until the status changes to a proceed.

Yes, it shows the dealer completed the Brady check as required by law. Including the NTN on the 4473 is a requirement on the 4473.

NICS is run by the FBI. ATF has nothing to do with them.

I asked a NICS Legal Documents Examiner how many call centers they had.....she told me three. (this was two years ago)
I believe all "further reviews" go to West Va.

Does it happen, even if in a different format? IE, The digital copy is printed, or a back-up is made, etc.....

The FBI NICS is prohibited by law from keeping "Proceeds" beyond the close of the NICS business day. Transactions that result in a "Delay" may be held until the status changes to "Proceed" and erased at the close of that business day. If the initial check was "Denied" or a Delay status that changes to Denied......those results are stored permanently.

Conspiracy theories aside, I would believe that includes any medium.
***If the NICS Point Of Contact is a state agency the prohibition against storing NICS results does not apply.

The dealer is required to record the NICS Transaction Number and Proceed/Delay/Denied on the Form 4473. He is required by law to keep the 4473 for twenty years. (He only needs to keep the Denied 4473's for five years). If he goes out of business, the law requires him to turn over his 4473's and bound books to ATF.
