NJ: Buying handgun ammo online is now illegal?!

I guess I've been asleep.

I was tooling around online looking at the outrageous ammo prices and got this warning from Midway:

As of April 1, 2008, New Jersey statutes will not allow sales of handgun ammunition to New Jersey.
Please remove the item(s) from your Shopping Cart and begin the checkout process again, or close this window and try entering a different shipping address. NOTE: We cannot ship to a P.O. Box by UPS or send hazardous materials (e.g., aerosols, flammable liquids, loaded ammunition, primed brass, and etc.) by USPS

Can someone cite the relevant statute?

And if this is true, where the HELL was the NRA and ANJRPC?

Screwed once again. Now I have to pay double at the local store and watch the guy write my name in a book for buying a box of ammo.
 
The problem is the law only talks to and relates to NJ brick and mortar premises but due to an abundance of caution a very few online retailers are doing this.

I don't know why Midway are doing this all you need to do is fax a copy of the FID as they do for Illinois residents

Update.

Just got off the phone with Midway and was told that they are working to intregrate the NJ FID with IL FOID so you will be able to fax the FID in to purchase ammunition.

Time line is after the new year apparently.

Depending on others to secure "your" rights, gets you what you deserve.

Unfortunately, yes... 2C:58-3.3:

No person shall sell, give, transfer, assign or otherwise dispose of, or receive, purchase, or otherwise acquire handgun ammunition unless the purchaser, assignee, donee, receiver or holder is licensed as a manufacturer, wholesaler, or dealer under this chapter or is the holder of and possesses a valid firearms purchaser identification card, a valid copy of a permit to purchase a handgun, or a valid permit to carry a handgun and first exhibits such card or permit to the seller, donor, transferor or assignor.

This law went in to effect on April 1, 2008 (ironic, ain't it?)
 
Since state law ends at the state line and the buyer takes title FOB shipping point outside of NJ, the law is really irrelevant, if not totally meaningless.
AFAIK, the only outfits paying even lip service to it are Midway, the rude clowns at Century, and the unlamented makarov.com.

Dcal, I copied the note to NJCSD earlier.......Ah we all love the joys of living in NJ......:cool:

As and when post Heller lawsuits wend their weary way through the legal system and hopefully we get 2A incorporated then we should have a good base for challenge on both interstate commerce as well as restriction of a constitutional right under color of law grounds.

I did politely harass the folks at Midway explaining the law

1. Only applied to handgun ammunition not all ammunition
2. Had no authority over non "bricks and mortar" interstate sales
3. Faxing of the FID as already happens for Illinois residents would meet even the most paranoid lawyers requirements.

I did get a response saying they would be moving to the Illinois FOID method but wouldn't be happening until after the new year.
 
Clear viloation of interstate commerce clause. Should be easily defeated and found unconstitutional. Question is who is willing to jump through the hoops to get the decision?

Hmmmm - not very High Road but I'll respond anyway in the hope that it was just unfortunate phrasing and you didn't mean to be snickering/nasty.

The NRA and ANJRPC collect dues from us to watch over and fight this stuff. I have a day job, and in matter of fact I was very busy starting a business earlier in the year so I guess it's possible I missed it. But I don't remember any of my friends or brother mentioning it . . . . I guess it was me because everyone else remembers it.

Seems like we put a crink in the 50 cal thing, wonder why this made it through if we had the same group (less me) calling and writing.

DCAL - thanks for the invite. I have been looking at your site and intend to join when the $$$ flow a bit better than they are right now. I'm an IT consultant and I'm caught in this frozen economy at the moment (or whatever we are calling it.)

Hopefully black Friday is good, the market bounces a little bit, the media stops shrilling and everyone relaxes a bit and gets back to staffing slots.
 
Wrote my legislators, but if WA enacts this, I'll just move back home to Montana earlier than planned. Seattle/Olympia/ Tacoma . . . San Francisco North.
