Norinco M97 clone and C&R?

I've been looking at getting one of the Norinco Trench Gun clones. I've heard both good and bad as far as fit and finish but i've pretty much relegated myself to one of these because I won't ever be able to afford the real thing. I've not seen any of these locally, going to be asking my local shop if he knows where one is but if nothing comes of that I might sign up and try GunBroker.

I've browsed gunbroker for awhile and always see the FFL requirements, transfers and the like. But what I wonder is if I was to buy a Norinco M97 and send the seller a copy of my Curio and Relic License, would he then be able to ship directly to me or would I still need to do the seller to dealer to me transfer?

I know in the book the original 1897 is listed, however I don't know if a Norinco made now, based on the 1897 design would count under the C&R?

Simple answer, no!

Unless it is on the C&R list by manufacturer name and model, or was actually manufactured more than fifty years ago, it is not a C&R. There are a few exceptions made for special, rare, or stuff like commemorative guns recently manufactured that get declared as C&R by the ATF but haven't made it on the published list yet (like the CZ82), but I am willing to bet my bank account that a any recently made Norinco whatever has not been declared a C&R by the ATF.

There is a small chance I am wrong, but I say save yourself the trouble and pay the extra 20 bucks or so to have it sent to your 01 FFL and then have it transerred to you.
 
Modern produced commerical copies of C&R guns are NOT C&R qualified.

OTW, C&R Holders could get Kahr Tommy guns, numerous 1911A1 variants and other newly manufactured copies of ancient designs delivered right to their door, and the alphabet boys don't want that.

There are exceptions such as commemorative runs that someone asked the ATF to put on the list because of their value as a curio.

For instance, if Winchester had a 125 year anniversary commemorative gold plated of a model recently made, it could be asked to be placed on the C&R list by serial number, or by the entire series.
 
Figured as much, just wanted another few folks point of view to make sure my reading of it was correct. Looks like I'll have to go through the local guy and his markup anyway lol. Oh well, price I pay. I've wanted one of these for so long I'm at the point where I'm about to say it's worth it... Just been dragging my feet for GunBroker signup because.. Well.. Frankly, there is just a lot of nice stuff on there that I can rationalize buying lol


Allthough, I don't do too badly with my bids on Cigars, and I've been respectable with e-bay... Might give it a register when I get home from work.
 
Looks like I won't have to go to Gunbroker, went to my local shop today... well as local as you can get 43 miles north of me, said he had 5 of them in stock but had just sold the last one. Guy hadn't picked it up yet so he brought it from the back and showed it to me. Not as bad as I expected. He's gonna put in an order for me, should have it in the shop next Monday. Thanks for the help everyone. Whenever my memory goes fuzzy on gun laws you guys never fail to come through and whack me with the common sense stick lol
