Normal or Negligent? Gun in car.

In many states (Missouri is one), your house is treated as an extension of your home in some respects. Firearm carry and defense are some of them- no permit needed and castle doctrine extends to the vehicle.

That said, I wouldn't dare leave a gun in the car (without a lockbox) when handing the keys to somebody a the shop. If the car is going to be in there for an extended period, I wouldn't even leave it in a lockbox. The only time I leave a firearm in the car is if I am entering a location where carry is not allowed.
 
30+ yrs ago when I worked for a Chevy dealer, some guy brought a pickup in for service with a holster mounted on the inside of the driver's door - with the gun still in the holster!

AFAIK, nobody bothered it - I sure didn't.

This was in CO so it was perfectly legal then and now.
 
It may not be criminal, but neglience is a civil matter, and the standard is pretty low.

Just remember the context in which it will be decided.

Someone will have been injured by some low life who has no insurance or assets. Some very smart people will be looking around for someone who does have insurance or assets to sue. The judge or jury will be evaluating your behavior in hindsight, when it has already been shown that in fact something bad happened because of your actions.
 
Negligent is a pretty ugly word and way over used on this board IMO. Some of the same folks that toss that word around are some of the same folks that claim you need to have a gun on your person 24-7 so leaving your gun any where is wrong/negligent to them. by no means is this negligent but not a smart move.

YOUR firearm should remain under YOUR control. Locking it in the car while you dash into the post office to buy stamps is one thing.
Kinda contradicts the first sentence. What if you were involved in an accident the medics wont leave it in the holster on your belt I asure you.(an extreem situation I know)
I ride with my 1911 stuck inbetween the seats. If I take my truck to the shop I place it in my back pack or in my waist band if I have an over shirt.

I am astonished at the number of folks who don't recognize the potential civil liability
civil liability? how so? where is this location?

As far as a lock box well if it is a shop I am certian there is a hand grinder near by it would have to be a group doing but a lock box is hardly going to stop a shop from getting in.

Nomatter how it was obtained a stolen firearm is just that........stolen you are not negligent if your gun was stolen.

I must point out, when you leave your gun in your car, you are leaving behind TWO deadly weapons.

Yes, it is possible the mechanic is a criminal and will go on a shooting rampage, or he may just drive out of the shop and start running over schoolchildren in the crosswalk. Would you be responsible for his criminal acts with your car? I'd say no. I'd say no negligence if he took your car and killed someone, or took your gun, or took that bungie cord you keep in your trunk and strangled someone with it.

Is it stupid, ill-advised, moronic, and a whole bunch of other things? HELL YES.

Negligent, no. Unless someone is going to back that up and post of a case where someone was actually charged and/or convicted, nope.

Second, from another angle, if you fear the slight chance that someone in your autoshop might be a murderer, wouldn't you want your gun on you? Not so he can't get it, but just in case he has his own, or a big frigging wrench. A killer will always find a tool. Hence, I say don't plan on stopping the killer by denying him a single tool, but by countering whatever tool he has with one of your own.


1) My colleagues and I make enough money to buy our own stuff. With $25,000 to $100,000 worth of tools or more, why would we need to steal your stuff? I probably make more than some of you.
Yea, well a lot of criminals ahve a bunch of nice fancy stuff, and more money than me, and they STILL STEAL. P.S. So does the government, and so does a lot of the megarich. That's how they got that way, not afraid to steal from the less fortunate.

Having some one elses property with out permission equals stolen property. Is it negligent if your house cleanes steals your gun safe/locker or even your night stand peice?..........NO!

Probably Not.

Would it be considered negligent behavior?
If it gets used in a criminal manner and you live in California they'll hang ya.

As far as mechanics being trustworthy or not trustworthy there are honest people and theives in every profession.
 
As a former Jiffy Lube employee, I would strongly discourage everyone from leaving ANYTHING in their vehicle. I had coworkers that would steal the quarters out of people's cars. If they found a camera or cell phone, you can bet they'd take it. I know one employee had several illegally-owned firearms. He even had two hand grenades. He tried to sell them to me. If he came across a gun in a car there's not a doubt in my mind that it would have been snatched and passed on to someone outside the store before you even realized it was missing.

I don't feel it is negligent, but I know I would feel aweful if any of my guns were stolen and used in a crime simply because I didn't feel like taking it out of the car ahead of time.
 
As far as the jiffy lube worker I would have fired the SOB and gave him a reference as a thief!

as far as leaving My firearm out of My control! negligent! Bad idea!

When and if I take my car in to a shop. my gun is on me concealed where it is supposed to be as I leave!

I used to actually put quarters in my cup holder and tell them they were there when I gave them my keys!

some times good! sometimes gone! and then you know!

Grandma always said: If you will lie! yoy will cheat, and if you will cheat! you will steal! and if you will steal, you will kill! Its startin to beome clearer now what she was talkin about!
 
My thought is that if your firearm is not secure, then you are negligent. Is your firearm secure ?
 
Unwise. I do not even leave change in the car when I take it to the shop. They say locks are to keep honest people honest, freebies are hard to pass up - hence the entrapment laws we have.
