New AWB in Pipeline thanks to Joe Biden...

"Innocent until proven guilty" is ostensibly still the law of the land.

One doesn't have to prove guilty intent to establish that a weapon is prohibited. ATFE could easily confiscate prohibited weapons without ever getting a conviction.

Terrorist Disarmament Act of 2008

Black rifles are big business now... 100 fold from when the original Assault Rifle Ban was passed.. There will be a signifigant amount of outrage by owners and manufacturers...

Like the outrage of Californians and manufacturers about microstamping? Sure business is booming. Fear of another AWB is real. The outrage will fall on deaf ears. "You are either with us, or with the terrorists". Choose.

Plus we have the Parker case that could potentially nullify all of it.
If anything, Parker / Heller will strike down an all-encompassing and overreaching weapons ban under certain, extremely limited circumstances. The SCOTUS decision, if there is one, will be narrowly written. Its effect on other registration laws and firearm or component restrictions will be nil.

Might as well start calling this the TDA. It will pass. Bush will sign it.

"With the terrorists"?

Does Joe Biden have any credibility whatsoever in combating terrorism?

Or much else?

1% in the Democrat primary, despite having a very well-known name?

In all seriousness, this could go somewhere, or not. Just like every year. But Joe Biden, for a very senior Senator, does not carry all that much clout in anyone's mind but his own.

Remember, both houses, need to pass the EXACT same version.

Ever heard of the "enrolled bill" rule? Both houses do NOT have to pass the exact same bill. The leadership of both houses have to be willing to claim that they passed the exact same bill. You can prove they're lying? The courts don't care.

Your mistake is in thinking the Constitution is actually in effect anymore.

Not intended to pass, now. The bill is designed as red meat for the moonbat fringe of the Democrat party. The bill will help Hillary or Obama or whoever get through the primary and into the main campaign but will be conveniently forgotten. The bill is a clear statement of the Democrat's intent given a return to power.

Now is the time for another bitch-slapping of congress similar to Amnesty I, Amnesty II, and the DREAM Act. We need for our representatives to develop a flinch every time they hear the fax machine sign on. There is no doubt in my mind that congress respects the power of the internet, talk radio, and voluntary organizations to keep up with their nonsense.

This ain't gonna pass. First off, the Iraq War is winding down. I'm pretty sure we'll be gradually pulling our troops out during the next presidency. Next off, nobody is going to buy this 2002 pseudo-speak. The bill is too much gun control for the right and too little for the far left. It's not going anywhere. Alert your congressmen, but don't fear this bill.

It is sad the Republicans started using that mantra about the war. It is now so effective with challenging a large majority of the country it seems. Well at least with the hardcore GOP.

We need to write our Congress Creatures. It seems that the leading candidates of both parties are anti-gun.

Don't need to TRY to ban weapons. That is a strong point with MOST Americans. They CAN however ban ALL foreign ammo, and tax the hell out of domestic ammo. Same effect, but a lot easier to push through.:(:(:(

`(C)(i) A semiautomatic pistol that has an ability to accept a detachable magazine and has at least 2 of the features described in clause (ii).

`(ii) The features described in this clause are--

`(I) an ammunition magazine that attaches to the pistol outside of the pistol grip;

I find the vagueness in that piece of text disturbing. If the anti's were to conveniently ignore the "2 of the features" thing, then it would effectively ban all semi-auto pistols (1911s, SIGs, Berettas...etc).

Just to clear things up, the section you quoted is not referring to magazine wells inside of the pistol grip, it is referring to items like the Tec 9 or AR pistols.

So, this is how you become a home grown terrorist. They pass an illegal, unconstitutional law that sets a mandate. This is communism at its finest, the last plank of the communist manifesto. To systematically disarm the American people. Read my lips, I only follow the Constitution, period. There will be no compromise, no discussion, no debate. You are either with us or against us. Our govt has become the domestic enemy. It is time for the sleeping giant to rise. It's time to go from defensive to offensive.

Re the above referenced proposal,or anything else of concern to you, when did you last contact your elected things?

Sir:

These bills are always a battle and always worth fighting. Few things are sure in this world; certainly not sure is your matter-of-fact assertion. So please, why don't you just lay down and be quiet....otherwise you're just getting in the way of the rest of us who are going to fight tooth and nail for our rights and yours.

There is no way Harry Reid is going to let this fly. Reid will be DOA next election as will Webb and Tester. (A long way off for the last two though>) Remember that Chucky and Teddy had to ignore the pro-gun stances of the many many Dems who helped them gain control of the senate and to some extent the house.

I agree with Waitone. This is just to rally the poor inner city folk who always cry for more gun laws.

Ummm... your not familiar with The Communist Manifesto are you? Actually it would be people like me and you rising up to overthrow our oppressors, not the government disarming us.

Exactly. That doesn't come until after the revolution. Then a handful of your most powerful compatriots disarm you and the execute you to eliminate you as a threat to their control.

I have to agree with Yamato on this one. What's with all the defeatist attitudes?

what i dont understand is the constitution is the "law of the land" and so why when is is in black and white "the right of the people to keep and bear arms, shall not be infringed."

am i stupid or just wrong

Are you referring to Montana-boy Tester, Glenn V?

As a Montana-boy I can tell you with confidence that if Tester was to back this bill after his campaigning on an anti-gun-control platform, his days in office would be numbered. He would be a pariah in his own state.

I'm picking up my 1st AR next week. I'm sure Senator Biden absolutely LOVES Delawareans like myself. And yes, as others have said he's basically irrelevant.

I keep repeating this: The 2nd Amendment has no teeth, as there are no negative repercussions for politicians who pass laws counter to its simple meaning, and so far the courts are willing to play ball with them.
