hadnt considered race palying a part in this. I know Gus is white from the news coverage. As for the ethnicity of the co-workers and criminals I dont think it has been mentioned
The employee who was being pistol whipped was black
 
And if a civil suit goes forward the prosecution will have a field day with the fact. Moving a body/tampering with crime scene yeah its laughable.

Don't know what that's based on but "fact" is, it's not a civil suit to move a body or tamper with a crime scene. It's criminal. Civil suits have nothing to do with it. Both misdemeanors, btw, and neither applicable to that case. It's a crime to move a body to cover up a crime or tamper with a crime scene for the same reason.

A civil suit of unlawful death or even a lesser excessive force would hinge on whether or not the gentleman felt threatened and was thus justified to shoot. Having four *armed* men beating his employees and threatening death to everyone there sort of makes an unlawful death suit a joke. Yes, it's laughable.

In England, there might be a case. England apparently makes it illegal to defend yourself or harm a criminal involved in the commission of a crime. The US doesn't. Here, the law gives you the right to shoot to kill if you feel threatened. Civil law doesn't preempt that.

He's on Fox News right now saying that the 2 guys who lived shouldn't go to jail, maybe supervised probation or something instead. He said that jail makes criminals. Strange stuff.
 
He came off very well in the phone interview on Fox & Friends this morning.

He did well to stop shooting once the last 2 were heading out the door and no longer a threat.

It was mentioned that his shotgun was "registered".
 
+1 for Gus, "three 21-year-olds and a 29-year-old - came prepared with a pistol and plastic handcuffs" 2 had prior records or assault, robbery, and weapons possession, I guarantee that if those 4 GROWN men were at their home and the police came to arrest them they would treat ALL of them as armed. If I saw 4 men trying to rob me and they had plastic handcuffs, and one of my employees was a women?! I'd fear for her safety and the chance they might kidnap or violate her, I wouldn't hesitate to shoot.

Also there is a police station just around the block, and Gus said he had been robbed several times before, if living close to a police station isn't safe, protecting yourself and your coworkers and lively hood really does fall unto you. Oh and I think PG is the best option for a store owner, easy to just stash it under the register, rarley use, not doing anything like skeet shooting or target practice, it's intimidating and quick to deploy with out banging into his merchandise.
 
Has he gotten his shot gun back? Or has he bought another one. In either case people know he is without arms.

It could of turned out real bad if it wasn't for the owner's possession of the shotgun and to think how many other crimes could be prevented if NYC allowed their law abiding citizens to own firearms without the current hassle.
 
Another thing I would be interested to know:

Did he keep one in the chamber or did he pump the weapon just before firing the first shot? I'm guesing by the effectiveness of the fire, that a shell was already chambered.
 
In going back to the NY Times and reading about Mr. Augusto's return to his store, there was one thing that stuck out:

“I know the pain these people must feel,” he said, referring to the families of the two who were killed. “I don’t know what feels worse, now or when my only son died.”

Just a reminder that, despite all the hoopin' and hollerin' that goes on in internet forums, there are lasting consequences to a self-defense shooting, even if you did everything right.
