Another side effect of the requirement for electronic medical records. Your confidential information is easily queried by any agency claiming jurisdiction over such information.

If this information stayed with your doctor only (inaccessible without a warrant), it is unlikely we would be having this problem.

The onus should continue to be on the medical professional to determine if the individual circumstances of the patient warrant notification to LEOs. Blanket action based on prescription of certain meds sets a dangerous precedent.
 
Having left the State of New York some thirty years ago I have become convinced that you have to be crazy to continue to live there and support that corruptocracy.
 
I worked for a hospital's IT department back when HIPAA went into effect, and was charged with upgrading the databases and security procedures for compliance.

Basically, HIPAA's purpose is to make it simple for governmental bodies and insurance companies to access your data. Almost all of the "privacy" parts are voided by the "allow anyone and his cousins access to your medical records" part of the release you have to sign before you can see a doctor or get a prescription filled.

You still have some measure of privacy and confidentiality... if you're paying cash, and your physician doesn't keep electronic records. Not many of those left.
 
What next. If you get a parking ticket you will be prohibited from owning a firearm???

For those who doubt that NYS is actually allowing the NYSP Pistol Licensing Bureau or any other nameless portion of this agency is making all attempts to subpoena or otherwise access medical records; you may want to look at this link from the Shooter's Committee on Political Education.

Now look at the Mental Health provisions of Toomey - Manchin Amendment. This should remove all doubt about where this is all heading. Veteran of Iraq - Afghanistan? You suffer from PTSD - no guns for you! (Why bother with a diagnosis, aren't all veterans potentially violent felons in waiting?) Went to a doctor regarding your sleeplessness - no guns for you!, etc.

If any mental health provisions are added to any background check bill (not recommended), it shall be confined to Involuntary Commitment as ordered by a legitimate court and a legal record, not confidential medical records held by a qualified medical professional.

NYC born and raised and like many left NY years ago, actually around 1969 when I was drafted. :)

Also lived many years in CA.

There are two places I have never had a desire to return to and those would be NY and CA. However, I do visit NY once a year to party with old friends on the beach. During the late 50s and early 60s it was a great place but today? Not my idea of a good place.
