can some one tell me how big of an objective lens is to big on a scope for a savage model 99e? would a 40mm fit? thx for your input
 
Sure it will fit.

Anything will fit, if the scope rings are high enough for the scope to clear the barrel.

Whether it will look right on a classic old lever-gun like a Savage 99 is a whole not her matter however.

A 40mm is about as big as you can get away with and still keep it looking right.

Be careful not to devalue your iron sights by getting too much scope. Picture this...your in the deer woods at 20 til daybreak and the buck of a lifetime is 30 yds away. Your scope is fogged up, and you can't see him because he's blending in due to the lighting and such. With a small objective scope, you use those high rise rings as intended and you can easily make the shot by using iron sights under the scope. If your gun is like my .270 then you are over scoped and can't use iron (which is why you carry a 357 or 44 like me) so your iron sights went from the most valuable thing on the gun to worthless in this situation. The scope came off of my marlin 3030 for this reason. It's not so much a gun that needs a scope anyway.
 
I'd go with a 2-7x35, 2-8x32, something like that. And no see-through rings.

Most guns I've seen in the woods are over scoped. I'd be more keen on something like a 1-4x for most lever guns. 2-7x or so like Haxby said would be my max.

And, again, no see-thru rings.

This is just wrong.

Even a decent mid level scope is going to be far better in low light than irons. A small 20mm objective lets in exactly the same amount of light at 4X as a 50mm scope does at 10X. At any power setting lower than 4x or 10X respectively, either lets in more light than the human eye can use. BIgger objectives allow you to use more magnification and still be useable in low light.

I've had more iron sights fail than scopes. In fact I've NEVER had a decent scope fail me. See thru mounts should be outlawed. They just make it harder to use both irons and optics. If you feel the need for both Quick Detachable mounts are the way to go.

I'd put either a 1-4X20 or 2-7X32 scope on it. If I just happened to have a 3-9X40 available and wanted to use it I would. But that is as big as I'd want to go.
