Obtaining an FFL permit

Which class of FFL are you looking for? ATF website is a good place to start to get info on requirements.


If you want to collect curio and relics, you need to apply for a C&R 03FFL. That is what I have used to buy CZ52, Mak's, Sistema's, etc...

The process is simple and cheap as long as you have an accomadating CLEO.
 
What does a CLEO have to do with a Type 03 FFL? You have to send a copy of the application to the CLEO, but he takes no part in the approval process.

If you want a Type 03 FFL (you won't be able to get a Type 01 without a bonafide business), send an e-mail to: [email protected] telling them your name, address, phone, and that you want a Type 03 FFL application. They'll send you all the forms you need to fill out.

I believe the fee is $35 for three years. I save many, many times that yearly in dealer discounts from Midway and Brownells.
 
When I applied for mine I had to get my local Chief of Police to sign off on the app. So technically he is a part of the process. And then send him a copy of the app for his files.
$30.00 for 3 years.
Just make sure that you get the "Certification of Compliance" form that certifies that you are a citizen. Basically all you do is fill your name out and sign your name. Why the heck they just don't put a space on the C&R app. and be done with it is beyond me.

A CLEO is very much involved in the process. Where I live, the Multnomah County Sheriff will not approve C&R's or give approval to buy silencers or full auto. However, in the city I reside in, the Chief of Police does approve them and I have been going to him instead of the Sheriff.

In addition, the Sheriff will approve CCW permits for in state residents but not for out of state. All the other surrounding counties will approve those however. He only issues the in state permits because he is under a "shall issue" legal requirement and has spoken out that he disagrees with it.

Politics are involved and CLEO's are not under a "shall issue" legal requirement for FFL's. Corporations are a different manner (and do not require CLEO approval) but they are not a viable option for your average joe blow citizen since you need to prove you will be in the business of selling and have a store front, etc.. The standards have been made tighter for a CORP FFL.
 
Definitely go to the ATF's site. Just remember that you will be required to keep detailed records. If you don't like doing paperwork, forget about it.

Funny, but a CLEO has no "approval" power for an 03 at all. He could only request that the BATFE deny the license, but I'm pretty sure this would only be possible with proper cause. And, I'm not talking about places like NJ where state law makes an 03 basically useless.

From the license application itself:

"INFORMATION FOR THE CHIEF LAW ENFORCEMENT OFFICER

This form provides notification of a persons intent to apply for a Federal firearms license. It requires no action on your part. However, should you have information that may disqualify the person from obtaining a Federal firearms license, please contact the Firearms and Explosive Licensing Center at (404) 679-6040. A "Yes" answer to questions #10 and #11 could disqualify a person for a license. Also, AFT may not issue a license if the activity would be in violation of State or local law."

So, I still believe that unless there is some State or local law preventing the NON-BUSINESS activites of a C&R collector, the Sheriff has no say in the application process at all.

sure they can deny your application around title 2 weapons, however there are ways around that as well. Form a corporation and have them purchase your weapons, they do not require a sign off in this fashion

I'm sorry, could you explain? If you have an NJ FID and a C&R, you can't take shipment of C&R weapons that are not explicitly banned in the state? Even assuming it is not a handgun which would require its own permit to purchase?

NJ has been an ongoing conversation as it relates to C&Rs, however, there appears to be some hope for collectors in that state. I'm not fully up on the issues, but you can find mutltiple examples of the difficulties at Parallax Bill's.

I think you're talking about the previous sheriff. Bernie Guisto, the current sheriff, used to be Chief of Police in Gresham, and he signed off on ATF 4 Forms. I believe hearing from my sources down there is that he's signing 'em, despite what Vera Katz thinks.

Thanks a million for that link. I had no idea there were C&R problems here in the PRNJ. I mighta screwed myself royally if I hadn't have read that.
 
ATF will approve the application if the applicant:

* Is 21 years or more of age;
* Is not prohibited from shipping, transporting, receiving or possessing firearms or ammunition;
* Has not willfully violated the GCA or its regulations;
* Has not willfully failed to disclose material information or willfully made false statements concerning material facts in connection with his application;
* Has premises for conducting business or collecting; and,

The applicant certifies that--

(1) the business to be conducted under the license is not prohibited by State or local law in the place where the licensed premise is located;

(2) within 30 days after the application is approved the business will comply with the requirements of State and local law applicable to the conduct of the business;

(3) the business will not be conducted under the license until the requirements of State and local law applicable to the business have been met; and,

(4) the applicant has sent or delivered a form to the chief law enforcement officer where the premises are located notifying the officer that the applicant intends to apply for a license.

(5) secure gun storage or safety devices will be available at any place in which firearms are sold under the license to persons who are not licensees ("secure gun storage or safety defined in 18 U.S.C. 921 (a) (34) ) .
