Suspect In Serious Condition; Police Say Case Still Under Investigation

OKLAHOMA CITY -- An intruder got more than he bargained for Tuesday night when he allegedly tried to break into a home in northwest Oklahoma City.

Oklahoma City police said a woman shot Ervin Donaldson twice in the chest while he tried to break into her home at 1221 N. Woodward St. near Northwest 12th Street and Grand Avenue. Officers said Donaldson knocked on the back door of the house just after 10:30 p.m Tuesday, asked to use the phone, then tried to force his way into the home.

A man who also lives in the house apparently confronted Donaldson and started fighting him. Lt. Don Holland said that's when the man's wife pulled out the gun and opened fire.

"The information we got ... he came to the back door, knocked on the door, (then the) homeowner came to the back door, (and) an altercation occurred at the back door," Holland said.

Donaldson was in serious condition Wednesday at the University of Oklahoma Medical Center. Police said the man who confronted him was also shot once in the hand, but added that his injuries aren't considered serious.

Police were continuing their investigation Wednesday evening. Officers said it would be up to the district attorney to decide whether the shooting was justified.

According to state prison records, Donaldson spent time in prison for seven burglaries committed over two days in 1997. He also served time on drug and trespassing charges in 1996.

Eheh... heh... That's a bad neighborhood... and I live in it for nine months of the year. I can guarantee the cops showed up only because there was a body. If nobody is bleeding, a "shots fired" call gets "call us if you hear anything else."

No Kidding...

Oklahoma has a Make My Day Law... Break into someone's home and the assumption is they are there to do you harm.

§21-1289.25.

PHYSICAL OR DEADLY FORCE AGAINST INTRUDER

A. The Legislature hereby recognizes that the citizens of the State of
Oklahoma have a right to expect absolute safety within their own
homes.

B. Any occupant of a dwelling is justified in using any degree of
physical force, including but not limited to deadly force, against
another person who has made an unlawful entry into that dwelling, and
when the occupant has a reasonable belief that such other person might
use any physical force, no matter how slight, against any occupant of
the dwelling.
In this case - what with the guy forcing his way in and beating on the husband there is little doubt (assuming the story is correct) that the guy was in the house, there unlawfully and intended to do harm.

If Wes Lane (the DA) charges the woman then there's way more to the story than is being told. He's a pretty pro-self defense guy and I cannot recall a single instance of him prosecuting a case like this since he was elected a few years back.
 
Why can't the papers write, "Intruder allegedly shot by homeowner" ?

Strictly speaking since the newspaper is reporting the supposed facts without having witnessed the event the headline should read:

"Alleged Intruder Allegedly Shot By Homeowner"

Obsfucation in all things!
 
The news around here is VERY republican oriented until some politically correct issue comes out- then it's "bleeding hearts" time. No honest FACTUAL reporting - just speculation with their production manager's twist on it. No need to rant on about this one, but a local store owner has chased a thief outside- shot him- and gotten into the crossbar motel from it. Go figure :eek:

I mean, how do we know that the occupant actually owned the house ????
