Hi all, fairly new here, do alot of reading a little posting, on this forum, anyhow. Was hoping someone could clarify the open carry law in Missouri? I know that we have concealed carry now, and can carry legaly in the car, with out a permit as I understand it. But what about open carry? Is a permit required? I have heard different stories on this. But would like some clarification. Thanks !!

Open carry is legal without permit, but is is very impractical because you subject yourself to harrasment and arrest from cops who dont agree. Charges probably wont stick, but they will make in very inconvenient

Open carry is prohibited by some local ordinances.

As a practical matter, you will only be okay if you are in a rural area during hunting season.

Otherwise, you will be arrested for "disturbing the peace" or the old "It was concealed from where I was standing" line from the cop (gun on right hip is concealed from cop on your left by your body.)

Missouri

Summary
While open carry is generally legal in Missouri, their preemption statute is unique in that it preempts the entire field of firearms law except for the regulation of open carry. Consequently, carrying openly in Missouri will expose you to a checkerboard of local ordinances.

it is VERY important we do not allow ourselves to be bullied into accepting someone's opinion as a rule. doing so circumvents an entire legislative process that was designed to promote liberty. they say - a right not excercised is a right lost. i disagree, i think - a right not excercised is a right FORFEITED.

...or the old "It was concealed from where I was standing" line from the cop (gun on right hip is concealed from cop on your left by your body.)

certain states (mine included) have legal definitions of the word "concealed" to prevent this type of statute abuse. truth be told - i had it go the complete opposite direction. i had a jacket over my fixed blade while hitchhiking as a youth. got questioned by LE and he wanted to know "do you have any concealed weapons". i said "i have a knife but it's not concealed" he's puzzled and asks "then where is it?" i raise my jacket as a turn around (behind strong side hip). after he ran me for warrants, he returned my knife and we parted ways.

Open carry is legal in Missouri, except where prohibited by local ordinances. Generally, if you are in a rural, unincorporated area you are good to go (legally). That doesn't mean that a leo won't harass you or question you. If you are in an incorporated area (city or town), you need to check local ordinances. Some quite rural towns have ordinances against open carry.

Best to get a ccw and carry that way. I often open carry when afield (hunting, hiking, etc.), but always ccw when in populated areas. You make your own decisions, of course.

Check out http://www.missouricarry.com/forums/showthread.php?t=57436 to see what can happen even where open carry is legal. This does not happen often, but is a worst case situation.

Open Carry as much as you feel comfortable. i doo all the time in Joplin and neosho. anytime im asked about it most often i get "Who do you work for" and i always respond "no body, i carry for your safety and mine" then i walk away. DO NOT talk to the cops. if they force you ask then if your being detained , dont explain your self, theres NO need, and it cant help you, just keep asking politely " can i go now" if they get aggressive ask for his supervisor.

of and DO NOT attempt to remove your weapon even just to hand it over to the officer
