Oregon Newspaper Sues Sheriff for Concealed Carry List

NEW YORK The Mail Tribune in Medford, Ore., filed suit Oct. 12 against Sheriff Mike Winters to obtain a list of Jackson County's approximately 6,500 holders of concealed handgun licenses. The paper is trying to learn how many teachers hold such licenses.

The issue arose out of other another suit, in which a high school teacher challenged the Medford School District's ban on employees bringing guns on school property. The Mail Tribune has looked into the matter as a school security issue.

Responsible for the handgun license list, Sheriff Winters denied a request, first made over a month ago, for the list, citing reasons of privacy and safety, according to an account in yesterday's Mail Tribune. Calling the list a public record, the newspaper maintains that refusal to disclose it is illegal, adding that other sheriffs' offices have turned over such documents.

Reporter Paris Achen quoted Editor Bob Hunter as saying, "This is information bought and paid for by the public, and the public has a right to it."

Hunter said the Mail Tribune said has no plan to publish license holders' names, seeking the information only to understand the reach a ruling on the Katz lawsuit could have.

Among other things, licensees are required to sign and application that states that the license is public record. The paper noted that Multnomah County has released license holders' names, birth dates and license numbers to The Oregonian and Willamette Week in Portland. The Sheriff's office there handed over its list reluctantly, fearing the information would be used for identity theft or credit card fraud.

The paper further noted that the director of the Oregon Firearms Education Foundation, which is financing Katz's suit, recognized that the licenses are public records, even though he would prefer to see the licensees' privacy protected.

Seems like the newspaper could get the list of teachers' names, give it to the sheriff's office, and that office could answer with the number of names that are on both the teacher's and CCW lists. Win-win.

They are claiming it should be public record and that they are doing society a favor. The blog, to me, is showing that they have intent to publish the records. Sorry, I can't seem to dig up the specific blog again, someone care to help. Gotta go get ready for a weekend trip.

That other thread has spun off into a general discussion of newspapers publishing lists of permit holders. This one's stayed more on the direct topic of what's happening in Oregon.

It should also serve as advanced warning that we need to get organized on this in order to protest it, and do all that we can to keep them from publishing the list of permit holders.
 
CCW Info

I live in a different county in OR., but have emailed the reporter, editorial staff of the paper, criticizing their efforts to publicize that information, and the Sheriff, in support of his strong stand against that action.
Hope it helps. The media sometimes forgets that the 2nd amendment is every bit as important in a free society as the 1st amendment.
 
Personal Info

Searching for public information on people is as simple as going to Google and entering the person's first and last name. Note that in some cases the first name you have will need to be "expanded" to it's more proper form. Jimmy or Jim would be James. Bob or Rob would more likely be Robert. Someone who goes by their middle name may be difficult to track without knowing what their true first name is (bt, dt - found him).

Once you get a list of hits, go to the bottom of the screen and search within results for the state.

In the case of one certain person I looked for, I had 10 possible hits, but only two of them were in the general geographic area of the state. One of those specifically listed his occupation, so I knew I had the right person.

Sometimes, you strike out though, if someone has an unlisted phone number.

More information might be available for a price. Your results may vary, depending on what you have to start with.

The information in that database was not "bought and paid for" by any part of "the public" except for those people who applied for Concealed Weapons Permits. They paid a fee to obtain their permits.

So what Editor Bob Hunter wants is information bought and paid for by people who applied and were issued Concealed Weapons Permits.

By Editor Bob Hunter's thinking, all information about him, his staff, the paper's executives, and all shareholders was "bought and paid for by the public" and everyone in this country--the public--has a right to it all.

Here is a media blog of some sort that came up in a Google search for the ownership of the paper.

I wasn't able to find out the onwership - I'm sure that said ownership would love to get calls on their home lines discussing privacy issues - but thought that the link I gave might be of some interest. The first comment is interesting.

If the paper really is interested in the number of teachers that are CCW holders, why didn't they just FOIA for the number of permits that list occupation: teacher and the total number of permits issued?

Oregon is shall-issue, right?

That means that, regardless of who has a permit right now, every single teacher in the county could get one if she/he wants one and has a clean record (which many may not have...). So the ruling impacts every teacher, end of story.

Now in California, which is "may issue", it would be completely legitimate for a newspaper to want to know who's getting the permits, and who isn't, and why. But in a "shall issue" state, this is a simple violation of privacy.

No, they're not interested. They just hope to ruin a couple careers. So when the recently fired teachers go to apply for new jobs and the employer asks, "so, why were you terminated by the previous institution?" they have to answer, "because they found out that I carried a firearm."

Between the three, I rarely fail to find who I'm looking for, and it's what I do in my "retired" job, (along with finding doctors by practice speciality; silly little unheard-of towns, municipalicies and unincorporated places; companies and businesses in business and defunct; medical conditions you've never heard of and don't want to have and a host of other arcane things).

Each has its benefits and constraints and I find Google the least useful due to its including every dingbat's reference to what you're searching for.

At any rate, there are a host of ways that anyone can be found, traced, tracked and otherwise personally violated; all legal and readily available.

This is the Medford paper we're talking about. Not the R-G or the Oregonian. I'd really suggest learning more about the situation or talking to the Firearms Education Foundation before starting any big deal about it.
