Is there any PA law that prohibits a gun dealer from transfering a handgun between individuals? Is there any issue, dealing with the above, concerning background checks?
Thanks.

In PA all handgun transfers must be done at an FFL, you must fill out the forms, and submit to a backround check... even if it's a private transfer. It stinks but it's the law.

I think the only exception is between family members.

Guys,
I appreciate the info, however you didn't answer my question.

I tried to do a transfer today between myself and another, and the dealer refused saying that PA law did not allow him to do a transfer between individuals.

Can anyone comment on this problem?

General Geoff is correct, there is no law that prohibits FFL's from doing private transfers. I sold a 1911 about three weeks ago and the FFL had no problem doing the transfer.

That is my belief as well. I spoke with another FFL friend and he confirmed all of our thoughts.
Not sure why the guy didn't want the $35 transfer fee, but he did inconvenience us.

He's probably mad because someone didn't buy the gun from him.

But like the other poster said, he also lost out on a transfer fee.

There is no law prohibiting FFLs from effecting the transfer. In fact, PA law demands that a handgun transfer go through either a dealer, or the county sherriff's office.

Note, however, that the law does not compell any FFL to do the transfer, though, which is why the Sherriff's office is in the mix.
