Pepper spray question - NYC

I'm thinking of getting pepper spray as a gift for all the women in my life this Christmas.

I have a niece that lives in NYC. Legal?

If it matters, I would be ordering from Sabre Red.
 
In NYS and NYC, it is perfectly legal to posses pepper spray, however, it must be purchased in-state at a gun store.
 
Careful with NYC, I believe it must be purchased at an authorized gun store or pharmacy in the city. The sale is recorded. NYS and NYC rarely have the same laws on this sort of thing.

In New York State, you have to buy pepper spray in person -- no mail order. I don't know about gifting it, but my guess would be that you could, to an adult, anyway.

I don't know about NYC, but AFAIK, in NYS it doesn't have to be from a gun store. I've seen pepper spray for sale at bicycle shops, for use on aggressive dogs.
 
Negative toivo- it can only LEGALLY be sold in gun shops and pharmacies in NYS. That said, I see it in dollar stores, and all sorts of other places and it doesn't seem to arouse any comments or concerns.
 
What about buying Tobasco sauce in NY? It contains the exact same active ingredient as pepper spray. You don't have to buy it in a gun store do you?
 
*sigh* Owen, I'm not saying I LIKE that law... simply putting forward what's accurate.
 
OK thanks, I'll just give her $20 with the stipulation that she has to buy spray with it.

Dog spray is not legally the same as pepper spray. Chemically, sure. it's considered different for legal reasons; one is used on aggressive dogs, the other, on people.

Is it maybe a different concentration? Dogs' noses are pretty sensitive, so maybe it doesn't take as much to incapacitate them.

One is used on snarling, vicious animals. The other is used on dogs.

(g) To possess or carry any instrument or device to discharge or emit
such gas or liquid... Five dollars
f. Violations. Except as is otherwise specifically provided in this
section, any person who shall wilfully violate any provisions of this
section shall, upon conviction, be punished by a fine of not more than
fifty dollars, or by imprisonment not exceeding thirty days, or by both
such fine and imprisonment.
