If that is true, why don't they simply reject hearing the case?

At this point, I give odds at 9 to 1 that J. Thomas is busily writing a dissent re: denial of cert in Peruta and the rest of the court is giving him time to finish.

I really hope I eat crow on that one.

Apparently, that's exactly what has happened. The Supreme Court posted a denial of cert in the Peruta case today (June 26, 2017), with two dissents (including Gorsuch).
 
Looking for a silver lining. Kennedy may be retiring soon, and Ginsburg likely won't hold on much longer either. Wouldn't it be better for the Supreme Court to rule on a case of this type after they've been replaced by a couple more Trump appointees?
