Pre 64 Winchester Model 94 won't stay closed

I recently purchased a pre 64 model 94. I am still in the inspection window for the gun.

You'll need to know a bit about lever guns and in particular the model 94 to understand the following:

Everything looks great with one exception. The action closes all of the way, but the small spring loaded button on the trigger stop that must be depressed by the lever to pull the trigger pops the action open again slightly.

If I hold the trigger stop button in with tape or my fingernail, the action closes fine and stays closed.

There does not appear to be enough slop in the lever movement to allow for a slight pushback from the trigger stop while keeping the action closed. Either that or some other angle is off...

I could image that the friction plunger that holds the action closed (underneath the gun on the lever cross bar) is just too weak. But aren't you supposed to grip a 94 to disengage the trigger stop before firing? Because in my case if I force the action closed such that the friction plunger engages, it definitely disengages the trigger stop. I can even get it to hold the action closed with the trigger stop disengaged (no hand in the lever...) if I close it just right and don't bump it. A slight bump again opens up the action slightly as the force from the trigger stop button overcomes the friction plunger that was holding the action closed.

Has anyone seen this before? Is there an easy fix for this or should I send the gun back?

This neophyte thinks that is normal - like a grip safety on a 1911 - ya gotta squeeze the lever closed to dis-engage the safety.
 
It's been a while since I held one, but even if you have to apply pressure to the lever to get the trigger to release, I don't think it should be opening the action up. I thought pre 64's didn't have this safety?
