Pre-Ban/Post Ban Confussion!

I am looking to pick up a 16" Upper for my DPMS Low-Pro purchased approx 10 years ago during the "Ban". The rifle has never had a flash hider, lug or any of the other items that would have put it in the bad gun category. My question is do I now have to order a Post Ban upper or can I use any of the attractive and equipped uppers? Also, as a side note, I am located in New York (not NYC) but NY State where I can handily purchase a new AR with all the goodies. Thanks in advance, Bill.
 
The Federal ban is gone. So as long as there is no law in NY that would preclude this, ordering a Pre-ban style upper with all the eevil goodies is fine. You still have to obey NFA, so the barrel must be 16" or longer.
 
Does New York State have an "assault weapons" law?

If you can legally purchase a brand-new AR-15 with adjustable stock and flash suppressor, then it would seem that purchasing those components for a rifle you already own would be legal. However, a handful of states in the Northeast have laws that replicate the expired (and much-hated) Feinstein law, and if New York state does, then you might be stuck with a smooth barrel instead.
 
New York - AWB NEVER EXPIRED!!!

You need to ask someplace with New York State locals to get the details, but here is the gist:

The New York State Assault Weapons Ban, which was modeled on the Federal AWB (but I do NOT know if it was IDENTICAL) NEVER EXPIRES!!! It is on the books until repealed. (Hah!)

Please check carefully before ordering anything that might be an AWB related item in NYS.
