Private sales between states....

If I wanted to go from Georgia to a gunshow in Alabama, would I be OK doing a private sale of a rifle there ? Also, could I sell a rifle here, to someone that came over from Alabama ? Thanks for any info.....M.
 
TO buy a rifle from another state, it is required that you transfer the rifle through a FFL. In state is different, but here a FFL is needed.
 
Any interstate transfer requires an FFL.

If you went to a gun show in Alabama, the seller there could give his rifle or shotgun to an FFL there for you to buy. If it is a handgun, the seller would have to give the pistol to a dealer in your home state and you would go through that dealer.

Same for selling, but in reverse. You could take your rifle or shotgun to a local FFL to transfer to the Alabama resident. For a handgun, you would take/send the pistol to a dealer in Alabama and the buyer would have to buy it in his home state.

Not all dealers will want to sell a long gun to some one from out of state, but it is legal to with possible exceptions for states like NJ, MA, CA, MD, etc...
 
I'm brand new so I'm not trying to argue; but wouldn't a FTF sale, by definition, avoid any issues of interstate transfer in the transaction? Especially between two NON dealers? Unless one stood on one side of a state line and the other on the other, and handed the gun over, shouldn't the two be able to make the transfer legally and privately?

I suppose this depends on the type of gun and the state; but I've always thought that two private citizens could buy/sell/trade a gun legally, face-to-face. without the need for any dealer involvement. Particularly since they would both be in the same state at the time. I can sure understand why the residency could be an issue when buying from a dealer in a state you don't live in, but I always thought that FTF transactions between non-dealer private citizens had less restrictions and was usually OK.

I'm probably wrong- you learn something every day. I'd be curious to hear a more in-depth answer. Is this because of the two particular states that the original poster mentioned or is this true anywhere?

Face-to-Face sales MUST take place only between residents of the same state, who are already not disallowed to own firearms in the first place. Period. Anything else is a violation of Federal law.

That's everywhere South Texas. You can buy a long gun in any state from a dealer as long as the sale would be legal in both states.
