Question about Buying/Selling at gun show

Hey people of THR --

I've been going to gun shows but I've never acutally bought anything other than ammo/ammo boxes for said ammo and mag's. Here's the thing - The next show is this weekend, in NY - Rochester. I'm a resident of MA though, I've bought a CZ-452 at a walmart in NY without any issues even though I'm not an resident of NY. If i try to buy from Gander's though, they say no. SO my question is, if I buy it from a guy at a gun show, would it be considered a FTF transfer, even though they do run a background check, they 'encourage' this kind of thing more often recently. I know this probably is an difficult question to answer but I hope an answer will come up becuase I have ideas of what to look for at the next show.

Oh - Forgot this - I can only purchase/own rifles in NYS.. Pistols require residency and a permit, both which I lack. Besides it's not what I'm looking to purchase anyway.
 
So you're telling me it's akin to a FTF transaction at a gunshow. So I can purchase a longgun, and take it back home to MA.
 
Not sure up there, but down in FL unless you have a CCL you have to wait 3-days to pick the gun up, but you can have it transferred to someone with an FFL. Not sure about across State lines though.
 
Some common sense... if you can walk into a gun show in MA and buy a rifle or shotgun and take it home, you can usually do the same in adjacent states unless that state has a different law or regulation affecting sales. Handguns are different. There should be no difference between buying a rifle at Walmart than buying one at a gunshow. Laws are exactly the same.

I live in TN and I can walk into a Walmart in GA or KY and buy a long gun and carry it out to my car. No problem. Some stores may have their own requirements such as Gander Mt. But, the law does not change.

If an extra form of some sort is necessary in MA, then my guess is that it would still be required.
 
First, forget that "adjacent state" business - it was taken out of the law years ago.

Here is what BATFE says:

"A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides."

Also:

"Generally, a licensee may sell firearms at a gun show located only in the same State as that specified on the seller’s license. However, a licensee may sell curio or relic firearms to another licensee at any location."

and:

"A licensed dealer may sell and deliver curio or relic firearms to another licensee at an out-of-State gun show. With respect to other firearms transactions, a licensed dealer may only display and take orders for firearms at an out-of-State gun show. In filling any orders for firearms, the dealer must return the firearms to his or her licensed premises and deliver them from that location. Any firearm ordered by a non-licensee must be delivered or shipped from the licensee's premises to a licensee in the purchaser's State of residence, and the purchaser must obtain the firearm from the licensee located in the purchaser’s State. Except for sales of curio or relic firearms to other licensees, sales of firearms and simultaneous deliveries at the gun show, whether to other licensees or to non-licensees, violate the law because the dealer would be unlawfully engaging in business at an unlicensed location."

Very interesting, because very recently (4 months ago) I purchased the aftermentioned CZ here in NY, and what Jim posted basically, says that purchase was illegal.

Ah well. I guess I can go tomorrow and see what happens... I wonder about the walk-ins though? Those are FTF transfers I'd imagine but would it be illegal, as seeing as the sale occured in NY and I'm an MA resident. Or is it totally private, between one person and another.
