Question about handgun waiting period

I received an email from someone asking about Florida gun laws as they relate to purchasing. I was pretty certain that Florida just goes by federal law, but I called a shop down there just to confirm.

Anyway, the sales person said that, yes, they just go by federal law: 18 for a long gun, 21 for a handgun, NICS check, and a three-day waiting period for handguns.

I questioned the three-day waiting period, since I thought that was up to the states.

The sales guy said, no, that's federal law.

Can anyone clear this up for me?
 
I thought Fed was 5 for handgun only with no waiting period on long guns.

I can tell you California's its 10 days on everything...

The things I learn.. so no waiting period federally gotcha
 
As a FFL holder I assure you there IS NO Federal waiting period.

That being said, let me confuse the issue some:

If the NICS check is "delayed" then I can legally transfer AFTER 5 days EVEN if the Feds DO NOT green light the transaction.

The five days gives the FBI time to investigate as to why the tranforee is "delayed" by NICS, and decide if the transfer is legal or not.

State laws vary wildly but thats the fed law
 
In Pennsylvania if you have all of the right ID and the computer works, just long enough to fill out the forms. Do you want hollow points with that?
 
newfalguy101, I'm aware of the delay period. I just didn't think that there was a federal waiting period. After all, "instant" is supposed to be instant when it comes to background checks.

Somewhere in Florida, gun buyers are having to wait three days longer than necessary because this sales guy doesn't know the law.
