Question about Legality of Handgun Sale in TX

I'm about to sell a handgun to a buyer in TX. He is a soldier stationed in TX, but is originally from NY, and hasn't changed his driver's license. If he shows me some sort of military ID with his TX address, would this sale be legal?
 
Assuming you are also a TX resident, if you want him to prove his residency to you, he does so by showing an active duty military ID card and a copy of his permanent orders to TX.

There is no requirement in law for him to prove his residency to you, however. If he lives next door to you, for example, or you know where he lives and pays rent, that removes reasonable doubt that he is a Texas resident.

ATF Rule 2001-5 says this (in part):
Held further, a purchaser who is a
member of the Armed Forces on active
duty is a resident of the State in
which his or her permanent duty station
is located, and may satisfy the
identification document requirement
by presenting his or her military identification
card along with official orders
showing that his or her permanent
duty station is located within the State
where the licensed premises are located.
