Question about title 2 / class 3 firearms

I am considering building an SBR. I know about the form 1's and BATF approval, etc. However, what happens if I move to a different state (Assuming SBR's are legal there)? Do I need to file any new paperwork, or does the original paperwork with my old address still work?
 
Yep, the ATF has to be notified of the change of address. I can't recall the specific form number though
 
It is a very simple form.... Form 5320.20....

It takes about 6 weeks to get approved...
 
I'm sorry for all of the questions, but does that mean I need to give the ATF 6 weeks notice before I move? What if I'm in a rush to relocate?
 
Moving NFA things...

My general understanding is that interstate moves of NFA firearms require approval on ATF Form 5320.20 (not called by anything like "Form 'x'"), which you can view online at their website:

Another site I found claims that in-state movement doesn't require permission from the BATFE (which would make sense to me, since the whole idea of the NFA was taxation, and that would fall under the whole "commerce between states" that Congress likes so much), but that if you're permanently changing address within the same state, they would much appreciate it if you let them know so that your address with them is current. I'm not finding anything that says that you *have* to, though.

You must file the form and wait for it's approval BEFORE taking the weapon out of state... also this form is required EVERY time you take the weapon out of state even if it is just temporary.
 
What if I'm in a rush to relocate?
If it is a rush move, you can store your NFA item in the state it is registered until the forms are approved. You can lock it in a case or locker and leave it with a friend or relative as long as they don't have a way to get to the gun while you are gone.
 
Safe deposit boxes are recommended by some as well, as long as the bank doesn't have any kind of clause prohibiting this.

Of course with an SBR that may not be practical at all, I'm thinking more like suppressors.
 
So let me get this straight, I need 6 weeks notice everytime I take it out of state?!?!?!

I live in north DE. I am 10 minutes away from PA, NJ, and MD. My gun club where I shoot is in PA. So can I file a 520 forms at once; one for every weekend of the next 10 years advising I might be taking my SBR to PA to shoot?

This sounds like way too much hassel just to hack a couple inches off a barrel. :(
 
Build an AOW instead of a SBR, unless you want a stock, of course. You can take AOWs and suppressors across state lines without permission. The other NFA items require prior approval.
 
Thanks, but I really wanted an M92 Krink. I could build one as a pistol, but I think it's worth the $200 tax to have a stock.

It doesn't seem to be worth the trouble of transporting it, however.

That does look pretty good, but I have an AMD-65 kit for a pistol build. I have a thing for shoulder fired weapons and was thinking a $479 krink kit would be a little excessive unless I was going to do it right and make it an SBR.

I think I'll just buy a krink kit now and sit on it. I plan to move to PA within the next few years, so I can register a receiver and build it then.

.... Unless I could just mail the ATF 520 forms for the next 10 years of weekends. :D
 
Before you give up, write to the National Firearm Act Branch at BATFE and ask them about frequent trips out of state. They might be able to help find a solution.
 
It would not apply in this case, but I think that if the NFA firearm is a C&R, you can transport it across state lines with a C&R license without having to fill out that form. I know you can with a Class 3 dealer's license, but that gets expensive.

I believe with an intrastate change of address, BATFE wants a letter, but I don't know if they require it.

If you're not moving permanently, a 5320.20 is good for up to a year.

So, you would need to file three of them - one each for PA, NJ, and MD. The dates, for example, could run from 07/01/05 to 06/30/06.
