can a 18 years old buy a gun from a friend on the state of florida?
If u private sell a gun, should u check the background and ID?
18 year old, can they buy ammo for a handgun?
My friend has a para-ordnance hi cap .45 which he is selling, well I want to get it, but Im only 20 years old. I checked with my local police derparment, he told me that a 18 year old guy can buy a handgun from a private seller, not from a ffl dealer, I try to find about in the internet but I couldn't find anything regarding this issue-I did find the florida gun laws the use the word:minor-. the cop also told me that if u carry the gun in ur car has to be with some sort of 3-step? he didn't explain very well, but in the pawn shop told that u can carry the gun in ur car ready to go?

Yeah you can buy it from a private seller.

Whether you should or should not check ID/background... I've bought and sold 3 or 4 guns on the side of a road with no paperwork, just a simple "Let me see your ID to make sure you are over 18." One of those instances was from a guy I linked up on a local car forum, he met me under a bridge in downtown Orlando, in an old white van, and his name was "Bubba".

Checking paperwork and/or making a bill of sale might not be the worst idea. Personally, the fact that I don't have to while other states require a bunch of nonsense means that I am going to exercise my freedom to do so.

The 3 step is BS. It just has to be in a container with a lid or latch. Center console, glove box. There are other ways of doing it in a car, but I'm not 100% sure on those, so I'm just going to tell ya what I know for fact. It can be loaded, one in the chamber, cocked and locked, whatever.
 
Just to be extra clear - yes, private sales are legal as long as both the seller and buyer are resident of the same state. Since the OP doesn't mention specifically that both he and his friend are both residents of FL, I thought I'd mention this. It's important. ;)
 
I was searching about it, but didn't find what a wanted some legal document from a legal web saying that a 18 years old can own a handgun on the state of florida, there be anyway that someone post it or tell me where I can find such info; we got pull over today, and they find the para. .45, they just went nuts, they put the gun in a platic bag and star telling us about the 3 step rule, after all they let us go, wasting about 1 hour. can they do this?

It depends on where they ‘found’ the Para…

If it was sliding around on top of the dash, they probably can.

Chapter 790.25 says nothing about the ‘three step rule,’ as noted it must be in some kind of container such as the glove box as long as ‘the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use.’

“Securely encased’ could be a zippered handgun bag, for example.

“…or is otherwise not readily accessible for immediate use.” This could be in the back seat of an SUV where you can’t reach it from the driver’s seat, even if the gun is out in the open.

FWIW I keep my firearms in a range bag in the trunk. No problems.

It might have started on the late Packing.Org about 10 years ago.I saw the saying repeated constantly while I was a member.
It seems to have taken on a life of its own!It's still going strong as we see.
 
The infamous "3 Step Rule" is the idea that if the gun is not three steps from being fired, it is considered "concealed".

Florida Statues specifically state that gun owners, whether CCW holders or not, can legally transport firearms, loaded or unloaded, in the glove box or center console of their vehicles. I guess this could be considered three steps - open console, grab gun, pull trigger = 3 steps.

I scratched my head for 6 months on this when I was 18. It was my first adventure in the understanding of all those fancy words and writing.

What it came down to was that typical US/states (maybe not Louisiana?) laws forbid you from doing something. If it isn't explicitly forbidden you are allowed to do it. Thus, it not saying that you have to be 21 to own/buy a handgun means that you are able to at 18.

At least, that's the way it's supposed to work. :rolleyes:

And yes, it took me 6 months of going "It doesn't say anything about it" to realize this means I'm in the clear.
 
If I understand what I have read correctly. You must be 21 to own a handgun or purchase ammunition for a handgun in Florida. You may own long guns at the age of 18 but not handguns. To expand on that, you may purchase ammunition that is common to handguns if the intention is to use the ammunition on a long gun chambered for that ammunition as in the case of carbines that use handgun ammunition.
 
Private sales of a handgun are permitted to an 18 yo in Florida if the purchaser is not otherwise prohibited from owning/purchasing a gun. It is only a purchase from a liscensed dealer which is restricted to 21 and over.

Yes, I think this is correct IIRC.
 
I spend the last 3 days reading the statutes and constitution chapter 790 of florida but i couln't find nothing about a 18 year old buying a gun from another person, private sell.
so because it doesn't say anything, that means that is legal?

Just curious.. Did they keep the gun, or give it back?? If they gave it back, perhaps that means it's ok to own it, if your 18?? Else they'd of probably kept it until an adu, err someone 21, came and claimed it??
